Fizisko personu datu tiesību krimināltiesiskā aizsardzība

Abstract

Maģistra darba tēma ir „Fizisko personu datu tiesību krimināltiesiskā aizsardzība”. Darba mērķis ir izpētīt Krimināllikumā esošo regulējumu attiecībā uz fizisko personu datu aizsardzību. Īpaša uzmanība tiks pievērsta tieši Krimināllikuma 145.panta izpētei un analīzei, kā arī tiks apskatīti un analizēti sekojoši Krimināllikuma panti: 94., 95., 144., 169., 200., 243., 245., 272., 276., 304., 329., 330., 352. pants. Tā kā Krimināllikuma 145.pantā iestrādātais regulējums attiecībā uz fizisko personas datu tiesību aizsardzību ir samērā nesens, tad darbs tiks veltīts problēmjautājumu identificēšanai šajā pantā un problēmu risinājumam. Darbā tiks aplūkotas arī problēmas, kas attiecās uz visu fizisko personu datu aizsardzības sfēru Krimināllikumā.

The theme of the master's paper is "Criminal protection of rights for physical persons on the personal data". The aim of the work is to study formulation of Criminal Law in relation to the protection of rights for physical persons based on the personal data. The special attention will be given exactly to the study and analysis of art.145 of the Criminal Law, and also will be examined and analyze the next articles of the Criminal Law: 94, 95, 144, 169, 200, 243, 245, 272, 276, 304, 329, 330, 352. Since the worked out formulation of art.145 of the Criminal Law in relation to the protection of rights for physical persons on the personal data is new enough, work will be dedicated to authentication of problematical questions in this article and resolution of these problems. In-process problems that belong to the whole sphere of protection of rights for physical persons on the personal data in Criminal Law will be also examined.
