Nepilngadīgajiem piemērojamie drošības līdzekļi, kas nav saistīti ar brīvības atņemšanu

Abstract

Maģistra darba nosaukums ir “Nepilngadīgajiem piemērojamie drošības līdzekļi, kas nav saistīti ar brīvības atņemšanu” Maģistra darbs sastāv no ievada, četrām nodaļām, secinājumiem un priekšlikumiem, izmantotās literatūras un normatīvo aktu saraksta. Ievadā izklāstīts pētījuma mērķis, mērķa sasniegšanai veicamie uzdevumi, darba objekts un subjekts. Ievadā dots neliels ieskats par drošības līdzekļu būtību un lomu kriminālprocesā. Pirmajā nodaļā apskatīts nepilngadīgo jēdziens un drošības līdzekļu vispārīgs raksturojums. Otrajā nodaļā ietverta nepilngadīgajiem piemērojamo drošības līdzekļu piemērošanas pamata un termiņu analīze. Trešajā nodaļā analizēti drošības līdzekļu izraudzīšanās nosacījumi. Ceturtajā nodaļā apskatīta kontrole pār uzvedības ierobežojumiem, kas noteikti ar drošības līdzekļiem un cilvēktiesību ievērošana. Darba kopsavilkumā autore izdara secinājumus, analizē problēmas, kas rodas, piemērojot drošības līdzekļus nepilngadīgajiem, un piedāvā dažus priekšlikumus problēmu risināšanai.

The theme of this master’s work called “Security measures, unrelated to the deprivation of liberty, applicable to juveniles in criminal procedure” It consists of introduction, four chapters, conclusions and proposals, the list of sources and legal acts. Introduction contains the research’s aim, tasks, the research’s object and subject. Introduction gives a short review of the topicality of coercive methods and their role in criminal action. The first chapter reviews the subscription of juvenile specifity and characters coercive measures. The second chapter reviews detailed analysis of security measure’s base and terms. The third part of the research reviews how to choose these security measures for juveniles. The fourth part reviews the control of security measures and observance of human rights. The final part of the research deals with conclusions. In this work author found and analysed problems, that affect adjusting security measures for juvenile and propose some suggestions how to resolve these problems.
