Maģistra darba „Darba koplīguma problemātiskie aspekti” uzdevums ir konstatēt un izvērtēt ar koplīgumu saistītās problēmas un piedāvāt savus ierosinājumus to risināšanai.
Problēmas koplīgumu slēgšanā rodas jau kolektīvo pārrunu procesā, kas pārsvarā darba devēja vilcināšanās dēļ var ieilgt uz nenoteiktu laiku, bet darbiniekiem nav līdzekļu, kā cīnīties pret to. Darbiniekiem ir tiesības uz koplīgumu, bet darba devējam nav pienākuma to noslēgt, lai gan darba devējs nav arī tiesīgs atteikties no sarunām par koplīguma slēgšanu. Krīzes laikā ekonomiskā situācija ietekmēja darba devēju spēju pildīt ar koplīgumu uzņemtās saistības pret darbiniekiem, īpaši skarot valsts sektorā strādājošos, kuru tiesības uz koplīgumā paredzētājām garantijām tika būtiski ierobežotas ar speciāliem likumiem, par ko pastāv viedoklis, ka tādējādi tiek pārkāptas Satversmē paredzētās tiesības uz koplīgumu.
Konstatējot, ka praksē tiek pieļauts noslēgt koplīgumu, kura noteikumi tiek attiecināti tikai uz darbiniekiem – arodbiedrības biedriem, autore maģistra darbā argumentēti ierosina šādu Darba likuma interpretāciju nepieļaut. The task of present Master’s Thesis “Problematic Aspects of Collective Agreement” is to establish and evaluate problems related to the collective agreement and to suggest recommendations for their solving.
Problems in concluding collective agreements arise already in the process of collective negotiation that can last for uncertain period of time due to the hesitation of employer while employees have no means to struggle against it. Employees have rights to the collective agreement but employer is not obliged to conclude it although the employer has no rights to refuse from the negotiations on the conclusion of collective agreement. During the crisis the economic situation influenced the ability of employers to fulfil the liabilities against the employees undertaken with the collective agreement, especially having an impact on those working in the governmental sector whose rights to guarantees stipulated in the collective agreement were considerably restricted with special laws. It is believed that therefore the rights to the collective agreement set forth in the Constitution are violated.
Finding that in practice it is permissible to conclude a collective agreement terms of which are attributed only to employees – members of trade unions – author, basing on arguments, suggests not permitting such interpretation of the Labour Law.
