Zusammenfassung
Maģistra darba tēma „Apsteidzošās pašaizsardzības tiesiskuma kritēriji ” ir aktuāla starptautiskā miera un drošības apdraudējumu dinamikas kontekstā. Pētījumā aplūkotās galvenās problēmas rada ne vien atšķirīga starptautisko tiesību normu interpretācija, bet arī dažāda valstu izpratne par Apvienoto Nāciju Organizācijas, kā nāciju rīcības saskaņošanas centra, pilnvarām un atbildību saistībā ar valstu starptautiskajām attiecībām.
Līdztekus apsteidzošās pašaizsardzības pieļaujamības, ar apdraudējumu rakstura maiņu saistīto starptautiskās drošības uzturēšanas tiesisko paņēmienu analīzei darba autore vērtējusi arī Latvijas iekšējo tiesību normu atbilstību valsts starptautiskajām saistībām šajā sfērā. Rezumējot pētījumu, nolūkā uzlabot Apvienoto Nāciju Organizācijas galveno mērķu nodrošināšanu, izteikti priekšlikumi pašaizsardzības tiesību robežu noteikšanai. Master thesis „Principles of the rule of law of anticipatory self-defence” is currently topical in terms of dynamics of threats to international peace and security. The issues addressed by the thesis arise not only out of the different interpretation of international law, but also due to the different view of countries on the authorities and responsibilities of United Nations as a centre for harmonizing the actions of nations as regards international relations.
In her thesis the author addresses admissibility of anticipatory self-defence, legal approaches as regards international peacekeeping due to changing threats, along with compliance of national norms with international liabilities in this field. Upon conclusion of the thesis, the author has provided recommendations on setting borders for self-defence law aiming at improvement of securing the key objectives of the United Nations.
