Kriminālprocesa pirmstiesas izmeklēšanas posmā, uzsākot kriminālprocesu un veicot izmeklēšanu tajā, procesa virzītajām jāsaskaras ar plašu risināmo jautājumu klāstu, kuru starpā ir arī mantiskie jautājumi un no tiem izrietošā problemātikā. Regulē šos mantiskos jautājumus kopsakarā ar citiem normatīviem aktiem Kriminālprocesā likuma sestā sadaļa, kurā ir noteikts likumisks regulējums jautājumiem saistītiem ar kompensāciju cietušajiem (26.nodaļa), rīcību ar noziedzīgi iegūto mantu (27.nodaļa) un mantisko jautājumu risinājuma nodrošināšanu (28.nodaļa). Pie svarīgiem mantiskiem jautājumiem kriminālprocesā attiecas arī rīcība ar lietiskiem pierādījumiem un dokumentiem, kuru iegūšanas apstākļi un īpašnieku (lietotāju) loks parasti ir ļoti plašs. Rīcību ar lietiskajiem pierādījumiem un dokumentiem regulē Kriminālprocesa likuma 12.nodaļa.
Šis darbs ir veltīts iepriekšminēto mantisko jautājumu normatīvajos aktos noteiktā regulējuma piemērošanai praksē un no tā izrietošai problemātikai. During the pre-trial investigation of the criminal procedure, upon a commencement of a criminal procedure and upon conducting an investigation in the course of it, the person directing the proceedings must deal with a broad range of issues including financial matters and issues arising thereof. Financial matters are regulated by, among other regulatory acts, Division 6 of the Criminal Procedure Law, which provides legal framework on matters related to compensating victims (Chapter 26), actions with criminally acquired property (Chapter 27) and ensuring of a solution to financial matters (Chapter 28). Also actions with material evidence and documents are deemed to be important matters in the sense of criminal procedure, the conditions for acquisition of which and the range of owners(users) of, is rather broad. Actions with material evidence and documents are regulated by Chapter 12 of the Criminal Procedure Law. The present thesis is dedicated to the review of applying this regulations.
