Zusammenfassung
Maģistra darba tēma ir ‘’Noziedzīgi iegūta manta’’. Maģistra darba mērķis, pētot un analizējot juridisko literatūru, tiesu praksi un ārvalstu regulējumu, ir noskaidrot, kā manta tiek atzīsta par noziedzīgi iegūtu, kā arī noskaidrot procesa par noziedzīgi iegūtu mantu piemērošanu praksē saistītās problēmas un piedāvāt to risinājumus.
Maģistra darba uzdevumi ir izpētīt noziedzīgi iegūtas mantas jēdzienu un tā vēsturisko attīstību, salīdzināt Latvijas regulējumu ar ārvalstu normatīvajiem aktiem, analizēt pastāvošo tiesu praksi attiecībā uz mantas atzīšanu par noziedzīgi iegūtu, noskaidrot pastāvošās problēmas un piedāvāt risinājumus.
Maģistra darbs sastāv no trijām nodaļām. Pirmajā nodaļā darba autors vērš uzmanību uz noziedzīgi iegūtās mantas vēsturisko attīstību, kā arī noskaidro jēdziena ‘’noziedzīgi iegūta manta’’ būtību. Master's thesis is Illegally acquired property. The aim of Master’s thesis is research and analyze legal literature, study case law and foreign law, and to find out how the property is recognized as the proceeds of crime, and to clarify the process of illegally acquired property of the practical application problems and offer solutions.
Master's tasks is to explore the concept of property obtained by crime and its historical development, to compare the Latvian legislation with foreign laws and regulations, analyze existing case law concerning the recognition of property proceeds of crime, to identify the existing problems and offer solutions.
Master's thesis consists of three chapters.
