Saprātīgs termiņš kriminālprocesā nav definēts kā konkrēts laika periods, kura neievērošana automātiski nozīmētu šī Kriminālprocesa likuma pamatprincipa un starptautiskajos tiesību aktos noteikto tiesību pārkāpumu. Pētījums ir aktuāls, jo arvien biežāk sabiedrības redzeslokā nonāk ziņas par tādiem kriminālprocesiem, kuri tiek iztiesāti pretēji saprātīga termiņa principam un tā izpratnei.
Pētījumā analizēti visu tiesu instanču pieejamie nolēmumi kopsakarā ar pētījuma mērķi, secinot un norādot uz nepieciešamību veikt grozījumus vairākos Kriminālprocesa likuma pantos, tai skaitā papildināt Kriminālprocesa likumu ar jaunu normu par tiesas pienākumu apsūdzētā prombūtnē (in absentia) izskatīt lietu pēc būtības, ja lietā atrodams kompensācijas pieteikums. Pētījums izstrādes gaitā izdarīti secinājumi par vairāku tiesību normu nevienveidīgas interpretācijas cēloņiem, kā rezultātā radīts iesaistīto personu tiesību aizskārums vai pārkāpums.
Pētījumā izdarītie secinājumi ir tieši saistīti ar iespējām veicināt tiesu sistēmas efektivizāciju. Reasonable time in criminal proceedings is not defined as a specific time during which the failure to reach a fair adjustment would automatically mean that the fundamental principle of the Criminal Procedure Law and the international law has to be applied and thus there is a violation of fundamental rights. The research is relevant since there is a considerableamount of cases that have gained public attention and have raised the question whether the criminal proceedings are adjudicated within a reasonable time.
The research examined all available decisions of judicial authorities, in conjunction with the goal of the research, finding and pointing out the necessity to amend various articles of the Criminal Procedure Law, thus the Criminal Procedure Law should also be supplemented with a new provision, that determines court to rule on the merits even when the accused is absent (in absentia) if the case file contains anapplication for compensation. Study reaches conclusions that several clauses of the Criminal Procedure Law are not subject to uniform interpretation and that has resulted in a violation or breach of the human rights.
The conclusions given in the study are directly related to the necessity to promote judicial efficiency.
