Publisko iepirkumu veikšanas Publisko iepirkumu likuma 8.1 panta kārtībā.

Abstract

Publisko iepirkumu likuma 8.1panta iepirkumu veikšanas kārtība tiek definēta kā atsevišķa no pārējām likuma normām nodalīta iepirkumu veikšanas kārtība, tādēļ, ņemot vērā tās savdabīgo definējumu, autores mērķis ir izpētīt 8.1panta regulējuma specifiskās iezīmes un ar tā piemērošanu saistītos problēmjautājumus – iepirkuma komisijas kompetenci, tās pienākumu ievērot interešu konflikta neesamību, iepirkuma atklātības nodrošināšanu, tehniskā dialoga veidošanas metodes, ar dokumentācijas sagatavošanu saistītos aspektus, tiesiskās aizsardzības mehānisma efektivitāti u.c. jautājumus. Darba gaitā autore secina, ka 8.1panta iepirkumu veikšanas kārtību nevar skatīt pilnīgi atrauti no pārējām likuma normām. Tāpat darba rezultātā par izskatītajiem problēmjautājumiem tiek sniegtas 10 tēzes, kurās iekļautas svarīgākās atziņas un problēmu risinājumi.

The procurement procedures stipulated by Section 81 of the Public Procurement Law are defined as a separate procurement procedure separated from the rest of laws and regulations; therefore, taking into account its peculiar definition, the author’s objective is to study the specific features of the regulation of Section 81 and issues related to the implementation of it – the competence of procurement commission, its obligation to comply with an absence of conflict of interest, ensuring the transparency of procurement, methods of creating technical dialogue, aspects related to the execution of documentation, the effectiveness of the mechanism of legal protection and other issues. During the work, the author concludes that it is impossible to look at the procurement procedure stipulated by Section 81 completely separately from the other laws and regulations. Similarly, there were 10 theses provided for the issues reviewed as a result of the work, where the most important findings and solutions of the problems were included.
