Lietošanas kārtības līgums kopīpašumā pēc dotās CL 1070. panta dispozīcijas nav paredzēts kā imperatīvs tiesību noteikums.
Līguma ierakstīšana zemesgrāmatā nav paredzēta nevienā no tiesību normām, tādēļ ne vien juridiskajā periodikā, bet arī vairākās Augstākās tiesas Senāta departamenta lietās rodas jauna atziņa, ka līgums pēc savas būtības ir saistību tiesība, kas saistoša pašiem kopīpašniekiem, tikai atsevišķos gadījumos, kas paredzēti tiesību normās, ir iespējama saistību tiesības ierakstīšana zemesgrāmatā.
Pētnieciskā darba mērķis ir izpētīt, kā līgums kopīpašumā atrisina īpašuma tiesību aprobežojumu, kas attiecas uz īpašumu visā tā apjomā (CL 1067. pants), jo kopīpašums ir viens no īpašuma veidiem, kurā īpašuma tiesība (CL 927. pants), pieder vairākām personām, tā ka sadalīts īpašuma tiesības saturs, bet ne īpašuma tiesība kā tāda.
Atslēgvārdi:lietošanas kārtība, kopīpašums, saistību tiesība. This master’s thesis analyzes the shared usage agreement of a property with several co-owners (users) which under the Article 1070 of the Civil Law (CL) is not considered as the imperative agreement.
Registration of the agreement in the Land Register is not required under the current legislation. As a result, both in the legal literature and in the cases tried by the High Court Senate there is an argument for classifying the agreement as the legal liability-creating agreement, pertaining only to the shared owners of a property and only in some cases registered in the Land Register.
The goal of this master’s thesis is to research the way the shared usage agreement helps to reconcile interests of the shared users of a property. The agreements pertains to all of the property (CL Article 1067), and the sharing pertains to the right of usage, not the right of ownership (CL Article 927).
