Prasības nodrošināšana civilprocesā

Abstract

Maģistra darbā „Prasības nodrošināšana civilprocesā” autore izpētīja prasības nodrošinājuma institūtu Latvijas tiesībās, kā arī analizēja tiesu praksi minētajā jautājumā. Autore izskatīja ar prasības nodrošināšanu saistīto lēmumu pārsūdzības iespējas Satversmes tiesas spriedumu kontekstā. Apzinot un analizējot ar prasības nodrošināšanu saistīto literatūru, autore konstatēja pamatproblēmas, tādas kā nekonsekvence prasības nodrošināšanas pamatojuma jautājumā, kā arī vairāku Civilprocesa likuma normu nepilnības. Maģistra darba noslēgumā autore piedāvā konkrētus Civilprocesa likuma grozījumus prasības nodrošinājuma institūta modernizācijai un uzlabošanai. In the Master work „ Providing of claim in Civil procedure” author has studied the Institute of Providing the claim in Latvian Law and has analysed the case law on the subject. Author examined an appel oportunities about the court judgements in context of Costitutional Court judgements. By identifying and analyzing literature relevant to Master’s work theme, author came to conclusion that there are an inconsistency issue about the boundries of cousation the providing of claim, besides that there are number of weaknesses in the Civil Procedure Law. As the result of Master’s work Author proposes spesific modifications in Civil Procedure Law to modernize and improve providing of claim in Latvia.
