Maģistra darbs „Nosacīta notiesāšana” sniedz ieskatu nosacītas notiesāšanas institūtā, kā arī nosacītas notiesāšanas piemērošanā Latvijas tiesību sistēmā un uzraudzībā pār nosacīti notiesātajām personām. Darbā aplūkoti aktuālie problēmjautājumi, kas saistīti ar nosacītas notiesāšanas piemērošanu un sniegti priekšlikumi to risināšanai.
Maģistra darba mērķis ir izpētīt nosacītas notiesāšanas institūtu, regulējumu likumā un ar to saistītos problēmjautājumus, kā arī sniegt risinājumus to risināšanai. Lai sasniegtu mērķi, tiek izvirzīti tādi uzdevumi kā apzināt normatīvo aktu bāzi, veikt tiesu prakses un ārvalstu likumdevēja pieredzes analīzi, analizēt nosacītas notiesāšanas institūtu vēsturiskajā aspektā, veikt doktrīnas analīzi, izteikt priekšlikumus apzināto problēmu risināšanai.
Darbā akcentētas likuma nepilnības un tiesu prakses kļūdas, kas galvenokārt ir saistītas ar motivācijas trūkumu spriedumos. Darba autore piedāvā iespējamos grozījumus Krimināllikuma 55.pantā un ierosinājumus ti Master thesis "Conditional sentence" provides an insight into the conditional sentence, the application of conditional sentence in the Latvian legal system and the monitoring of conditionally sentenced persons. The issues of conditional sentence and proposals for solving these issues are included in the master thesis.
The aim of the master thesis is to explore the institute of conditional sentence and the regulation of law and related issues and to give proposals for solving these issues. In order to achieve the aim several tasks have been put forward: to explore the regulation of law, to analyze courts of a foreign legislature, to analyze the institute of conditional sentence in its historical aspect, to analyze the doctrine and to propose the problem solutions.
In the master thesis shortcomings in the law and judicial errors are highlighted, which are mainly related to the lack of motivation in the judgments. The author not only suggests the possible amendments to the Criminal Code
