"Likumu plūdu" fenomens un juridiskās metodes loma likumdevēja pārmērīgās aktivitātes mazināšanā

Abstract

Likuma plūdu fenomena būtību raksturo likumdevēja lielais aktīvisms un rezultātā kvantitātei pieaugot, pieņemtie likumi ir ar zemu kvalitāti. Maģistra darba mērķis ir identificēt likumdevēja pārmērīgās aktivitātes, izdodot jaunus normatīvos aktus un to grozījumus, galvenos cēloņus, analizēt iespējamos risinājumus problēmas mazināšanai, kā arī aizstāvēt hipotēzi, ka ja problēmu var atrisināt tiesību normas interpretācijas ceļā, rodas iespēja izvairīties no jauna normatīvā akta pieņemšanas. Galvenie uzdevumi maģistra darbā ir sniegt likumu plūdu fenomena skaidrojumu, izpētīt tā vēsturisko attīstību un izvērtēt iespējamos risinājumus, kā arī tiesību piemērotāja lomu problēmas risināšanā. Maģistra darba rezultātā autore identificēs galvenos pārlieku lielā normatīvo aktu skaita cēloņus un analizēs priekšlikumus to mazināšanai, kā arī izvērtēs tiesību piemērotāju darbību nozīmi, veicot tiesību normu interpretāciju.

The purpose of this Master’s thesis is to identify the main causes of the abnormal activity of the legislator by issuing new normative acts and amendments thereto, analyse the possible solutions to alleviate the issue as well as to defend the hypothesis that in the event the issue can be resolved through interpretation of the law, a possibility rises to avoid issuing a new legal act. The main tasks of the Master’s thesis is to render explanation of the phenomenon of legislative flood, explore its historical development, evaluate the possible solutions and the role of the applier of the law in solving the issue. As a result of the Master’s thesis the author shall identify the main causes of the excessive number of laws and regulations, analyse the suggestions for diminishing thereof as well as assess the relevance of work of the law applier by performing legal interpretation.
