Politiskās noziedzības kriminoloģiskās problēmas

Abstract

Maģistra darbā ir pamatota politiskās noziedzības starpdisciplināras pētīšanas nepieciešamība, dots jauns politikas jēdziena definējums, to skaidrojot kā centienus ietekmēt publisko iekārtu, analizētas dažādas ārvalstu kriminologu izstrādātās pieejas politiskās noziedzības jēdziena izpratnē un norādīts uz šo atšķirīgo pieeju priekšrocībām un trūkumiem. Ir secināts, ka politiska noziedzīga nodarījuma izpratne kriminoloģijā un starptautiskajās tiesībās atšķiras, tāpēc pausts aicinājums starptautiskajās tiesībās šo jēdzienu pārdēvēt. Darbā arī ir vērtēts, vai politiskā ideoloģija var būt noziedzīga, un pausta atziņa, ka par noziedzīgu ideoloģiju var atzīt tikai tādu ideoloģiju, kuras neatņemama sastāvdaļa ir ideja par krimināli sodāmas darbības izdarīšanu. Tāpat darbā ir raksturota politiskā noziedznieka personība psiholoģiskā skatījumā.

The Master Paper substantiates the necessity of interdisciplinary research of a political crime, a new definition of the concept of politics is given, explaining it as an effort to have an impact on a public system, diverse approaches developed by foreign criminologists are analyzed for the purpose of the concept of the political crime, as well as advantages and disadvantages of the various approaches are stated. It is concluded that the understanding of the politically criminal act in criminology and international law differs, therefore, there is a suggestion to rename the concept in international law. It is also discussed in the Paper whether political ideology can be criminal, and there is an insight expressed that only such ideology can be acknowledged as criminal which can not be separated from the idea on committing a criminal act. Likewise, a personality of a political criminal from a psychological perspective is described in the Paper.
