Abstract

Kiberterora krimināltiesiskie aspekti. Darba autore Arta Šmukste. Darbā sniegts kiberterora raksturojums, skaidrots šis jēdziens, apkopoti viedokļi par tā saturu. Analizēti vairāki Krimināllikuma panti, kas ietver kiberteroram līdzīgas darbības un izvirzīti priekšlikumi par veicamajiem uzlabojumiem, ņemot vērā nepilnīgo aizsardzību pret nemantiska kaitējuma nodarīšanu kibertelpā. Uzdevumi: 1. aplūkot kiberterora jēdziena būtību; 2. analizēt tiesisko regulējumu Latvijā saistībā ar kiberteroru; 3. izdarīt secinājumus un priekšlikumus. Pētījumā secināts, ka Krimināllikums neparedz atsevišķu sastāvu, nosakot atbildību par kiberteroru, esošās tiesību normas pilnvērtīgi neaizsargā cilvēkus no psiholoģiskā terora internetā, pašreizējais regulējums nav atbilstošs attītajām informācijas tehnoloģijām. Darbs sastāv no trīs nodaļām, satur 72 lapas.

Criminal legal aspects of cyber bullying. Author - Arta Šmukste. The present Master Thesis characterizes and describes the notion of cyberbullying, and summarizes views on its contents. Several articles of the Criminal Law that include actions similar to cyber bullying have been analyzed. Suggestions on improvements regarding incomplete protection against intangible damage caused in cyberspace have been made. Enabling objectives: 1.To explore the notion of cyber bullying; 2.To analyze the legal regulations of cyber bullying in Latvia; 3.To draw conclusions and make suggestions. It has been concluded in the research that the Criminal Law does not envisage a separate rules that defines liability on cyber bullying; the legal norms do not protect people fully from psychological terror on the Internet; and the current regulations are inadequate as to the developed stage of information technologies. The amount of the Master Thesis is 72 pages and it consists of three chapters.
