Embrija tiesības uz dzīvību

Abstract

Maģistra darba izstrāde veltīta vienai no svarīgākajām cilvēka tiesībām – tiesībai uz dzīvību, fokusējot pētāmo jautājumu uz nedzimuša bērna (embrija) tiesībām uz dzīvību. Tika analizēta tiesu prakse par abortu veikšanas problēmām Eiropā, kā arī apskatītas nedzimuša bērna tiesības saistībā ar sievietes tiesībām kontrolēt savu ķermeni, kā arī tēva loma un atbildība jautājumos par grūtniecības pārtraukšanu. Paralēli nedzimuša cilvēka tiesībām uz dzīvību tika skatītas sievietes tiesības, ierobežojumi noteikt pār savu ķermeni, galvenokārt nevēlamas grūtniecības gadījumā. Attiecībā uz nedzimuša cilvēka tiesībām, sievietes tiesībām noteikt pār savu ķermeni, kā arī tēva tiesībām šajā jautājumā, bez juridiskiem aspektiem tika analizēta arī ētiska, filozofiska un reliģiska skata punkti. Atslēgas vārdi: nedzimis bērns, embrijs, auglis, persona, tiesības uz dzīvību.

The Master‘s paper dedicated to one of the most important human right-the right to life, focusing on the research issue of an unborn child (embryo) right to life. In the research were analyzed the case law on abortion problems in Europe , as well as a survey of the unborn child's rights in relation to the woman's right to control her body as well, as the father's role and responsibility for the termination of pregnancy. Parallel to the unborn human right to life was viewed women rights set restrictions over her body, mainly in the case of unwanted pregnancy. In the case of unborn human rights, women rights set over her body, as well as the father's rights in this matter, without legal aspects were analyzed an ethical, philosophical and religious points of view.
