Psihotropo vielu tiesiskās aprites kārtības efektivitāte un ietekme uz sabiedrību

Abstract

Maģistra darba mērķis ir noteikt dažu no mūsdienu izplatītāko psihotropo vielu, īpaši kanabisa kā izplatītākās vielas tiesiskās aprites izpratnes nepilnības, kā arī normatīvo regulējumu un ar to saistītās problēmas cilvēktiesību efektīvā īstenošanā.

Īstenojot mērķi, tiek aprakstītas saistītās problēmas ar psihotropo vielu aizliegumu un problēmu iespējamie cēloņi, sniegti atbilstoši priekšlikumi cēloņu mazināšanai, un skaidrotas iespējas mazināt un likvidēt problēmas, inovatīvi veidojot normatīvos aktus.

Autors norāda uz likumdošanas un sociāliem apsvērumiem iespējamai nepieciešamībai grozīt psihotropo vielu tiesisko aprites kārtību Latvijā, un ierosina grozīt likuma Par narkotisko un psihotropo vielu aprites kārtību 5.pantu, paredzot kanabisa kā izplatītākās psihotropās vielas medicīniskas aprites iespējas Latvijā un ievērotu starptautiskās tiesību normas.

The aim of the Master’s thesis is to identify the legal handling imperfections of some of the most common contemporary illicit psychotropic subtances, particularly that of cannabis as the most widely used substance, as well as the legal framework and the related problems for the effective implementation of associated human rights. Implementing the aim, the associated problems with the restrictions of psychotropic substances and the possible causes of these problems are described, and also possible solutions explained for the easing and elimination of these problems through innovative legislation. The author points out considerations for the possible necessity to change the policy for the handling of psychotropic substances and proposes the amendment of section 5 of the Law for the legal handling of narcotic and psychotropic substances with respect to the limitation of cannabis use in Latvia in order to establish a contemporary legal framework for possible medical uses in Latvia.
