The developement of technologies changes the nature of data processing and produces increase of data treatment which has created the necessity to consider perceptions about the extent of data processing is permissible and when it becomes excessive. The study derives an idea of biometric data understanding, treatment boundaries, confirms that the data processing regulation violates right to privacy and to informational self-determination, reduces data to a commercial level, violates the principles of data handling and the presumption of innocence because the data cannot be processed only for the future purposes. Criminal prosecution should be based on the evidence not on a presumption of every person as a potential criminal and the legitimate aim - the public welfare. In conclusion for the problems raised solving proposals are suggested.
