Eksperta atzinums un liecība kā pierādījumi kriminālprocesā

Abstract

Maģistra darbs ir par secinājumiem rokrakstu ekspertīzē, par praksē pastāvošo varbūtējo secinājumu interpretācijas problemātiku, kā arī par rokrakstu eksperta atzinuma kā pierādījuma novērtēšanas iespējām kriminālprocesā. Maģistra darba mērķis ir pierādīt, ka rokrakstu eksperta atzinums un tajā sniegtie secinājumi ir precīzi, ka tos var izmantot pierādīšanā. Maģistra darba uzdevums ir apskatīt rokrakstu eksperta atzinuma kā pierādījuma novērtēšanas iespējas, padziļināti izpētot ar to saistītos problemātiskos aspektus, piemēram, rokrakstu ekspertīzes subjektīvo pusi. Maģistra darba rezultātā autore sniedz vienu no iespējamajiem problēmas risinājumiem – skalu, kas attēlo secinājumu veidus rokrakstu ekspertīzē, secinājumu veidošanās likumsakarības, kā arī secinājumu vērtējuma intervālus izteiktus skaitliskā veidā.

Masters work analyses the conclusions in handwriting examination, the interpretation problem of probable conclusions within common practice as well as the evaluation possibilities of handwriting examiner’s testimony as evidence in criminal proceeding. The objective of masters’ work is to prove that the testimony of handwriting examiner and the provided conclusions are precise and can be used as evidence. The task of masters’ work is to examine the evaluation possibilities of handwriting examiner’s testimony as evidence by profoundly examining the respective problematic issues, e.g., the subjective side of handwriting examination. As a result of masters work the author provides us with one of the possible solutions to the problem – a scale that shows conclusion types of handwriting examination, the regularities of conclusions formation and conclusions’ interval of value given in numeral mode.
