Abstract

Bakalaura darba tēma: laulāto kopmantas sadale laulības šķiršanas gadījumā. Tēmas aktualitāte Latvijā ir neapstrīdama, jo laulību šķiršanu izvēlas katrs trešais pāris, lai atrisinātu problēmas, kas uzkrājušās kopdzīves laikā. Līdz ar to rodas jautājums par kopmantas sadali laulības šķiršanas gadījumā. Laulāto mantiskās attiecības ir viens no civiltiesību sarežģītākajiem jautājumiem, jo skar ne tikai laulāto savstarpējās attiecības, bet arī sabiedrību kopumā. Pamatvadlīnijas, pēc kurām tiesa vadās dalot laulāto kopmantu, ir ietvertas Civillikuma normās, tomēr tiesai jāizvērtē katrs konkrētais gadījums, līdz ar to arī vienoti risinājumi nepastāv un nav iespējams pilnīgi noteikti vienmēr apgalvot, ka katra konkrētā manta ir pakļauta kopmantas sadalei. Bakalaura darba mērķis ir analizēt kopmantas sadales būtību, jēdzienu, saturu, identificēt pastāvošās problēmas un sniegt priekšlikumus to risināšanai. Ņemot vērā izvirzīto mērķi un veicamos uzdevumus, autore bakalauru darbu ir sadalījusi četrās nodaļās, kuras pilnībā atklāj laulāto mantisko attiecību un laulāto kopmantas sadales laulības šķiršanas gadījumā būtību. Bakalaura darba kopsavilkumā autore izdara secinājumus, kas radušies pētījuma gaitā, kā arī izsaka priekšlikumus dažu aktuālo problēmu risināšanai.

Bachelor’s work theme: Dividing of common property of marital in case of divorce. Actuality of this theme in Latvia is undeniable, because every third pair goes for divorce to solve problems, that has accured during living together. Wherewith question arises as divide of common property in divorce case. Matrimonial property is one of civil rights complex issues, because affects not only marital interrelations, but also society overall. Guidelines after which justice follows to divide common property of marital is included in norms of Civil rights, however justice must apprise every case, wherewith no agreed solutions and no possible always to declare how each particular property will be shared. Target of Bachelor’s work: based on analyse of common property of marital to identify existing problems, as a result to draw conclusions and make proposals for improvements. Author guided by objective and enforceable tasks, devided bachelor’s work into four chapters, which gives an accurate insight into the point of matrimonial property and divide of common property. At the end of Bachelor’s work author, based on Bachelor’s work researches and identified problems, make conclusions and offer proposals.
