Bakalaura darba mērķis ir izpētīt bāriņtiesas kompetenci un lomu mantojuma lietu kārtošanas procesā, tās funkcijas un uzdevumus, izanalizēt problēmjautājumus, ar kuriem savā darbībā saskaras bāriņtiesas un mēģināt rast tiem risinājumu.
Darbs sastāv no trīs nodaļām. Darba pirmajā nodaļā tiek apskatīta mantošanas tiesību būtība un centrālā ideja, galvenie tiesību institūti, mantošanas kārtība, kā arī mantojuma lietu vešanas vispārējais tiesiskais regulējums.
Otrajā nodaļā, kas sastāv no 3 apakšnodaļām, izpētīta nepilngadīgo mantošana. LR Civillikums nosaka, ka nepilngadīgie var mantojumu pieņemt vai atraidīt izmantojot inventāra tiesību un tikai saņemot bāriņtiesas atļauju mantojumu pieņemt vai atraidīt. Līdz ar to tiek izpētīta inventāra tiesības izmantošanas kārtība un nozīme. Nodaļā tiek analizēta bāriņtiesas kompetence nepilngadīgo mantisko tiesību aizsardzībā, kā arī nepilngadīgo mantojuma pieņemšanas vai atraidīšanas kārtība. Bāriņtiesai, kā aizbildnības un aizgādnības iestādei, kas nodrošina bērnu tiesību un tiesisko interešu aizsardzību, ir būtiska loma nepilngadīgo mantinieku mantisko interešu aizsardzībā. Bāriņtiesai ir ļoti rūpīgi jāizvērtē nepilngadīgajiem piekritušā mantojuma sastāvs, lai varētu dot atļauju mantojumu pieņemt vai atraidīt. Tāpat, ja pēc apstiprināšanas mantojuma tiesībās, līdzmantinieki, starp kuriem ir nepilngadīgie, vēlās mantojumu sadalīt reālās daļās, ir nepieciešama bāriņtiesas atļauja.
Darba trešajā nodaļā pētīta mantojuma apsardzība un aizgādnība. Gadījumos, kad starp iespējamiem mantiniekiem ir strīds par mantojuma tiesībām vai arī mantinieki nav sasniedzami bāriņtiesai ir pienākums nodrošināt mantojuma apsardzību, lai novērstu tā izvazāšanu un vērtības samazināšanos. Gadījumos, kad par mantojuma apsardzību gādā zvērināts notārs, pēc tiesas lēmuma par mantojuma apsardzību, bāriņtiesai ir pienākums nodibināt mantojumam aizgādnību, kā arī uzraudzīt ieceltā aizgādņa darbības. Aizgādņiem ikgadu bāriņtiesai ir jāsniedz norēķins par mantojuma pārvaldību, kā arī izbeidzoties aizgādnībai ir jāsniedz galīgais norēķins. Aizgādņa norēķinu pārbauda un apstiprina bāriņtiesas priekšsēdētājs. The objective of the bachelor’s thesis is to study the competence and role of the orphan’s court in the settlement of inheritance cases, its functions and tasks, to analyse the issues the orphan’s courts face in their work and try to find the solution.
The thesis consists of three chapters. The first chapter of the thesis deals with the gist and the main idea of the inheritance law, the main legal institutions, order of succession, and the general legal regulation of conducting inheritance cases.
In the second chapter which consists of 3 subchapters the author examines the succession by minors. The Civil Law of the Republic of Latvia stipulates that minors can accept or decline the inheritance using the inventory rights and only upon receipt of the permission from the orphan’s court to accept or decline the inheritance. Thus the procedure and the meaning of inventory rights were examined. In the chapter the author analyses the orphan’s court’s competence in the protection of the minors’ proprietary rights and the procedure of acceptance or decline of the minors’ inheritance. The orphan’s court as a custody and guardianship institution which ensures the protection of children’s rights and legal interests plays an essential role in the protection of minor inheritors’ proprietary rights. The orphan’s court must evaluate the content of the minors’ inheritance very carefully in order to give the permission to accept or decline the inheritance. If upon the approval of the right to inherit the co-inheritors among whom are minors wish to divide the inheritance into real parts, they will need the orphan’s court’s permission.
In the third chapter of the thesis the author examines the protection and trusteeship of the inheritance. In cases when there is a dispute on the inheritance rights between eventual inheritors or the inheritors cannot be reached, the orphan’s court is obliged to ensure the protection of the inheritance in order to prevent its devastation and diminution in value. In cases when a sworn notary takes care of the inheritance protection, by the court decision on the inheritance protection the orphan’s court is obliged to set the inheritance trusteeship and to watch the actions of the assigned trustee. Every year trustee has to submit the account on the inheritance administration; the final account has to be submitted upon termination of the trusteeship. The trustee’s account is verified and approved by the chairman of the orphan’s court.
