Tiesiskais nihilisms,- kā tiesiskās apziņas deformācijas veids

Abstract

Bakalaura darba tēma ir „Tiesiskais nihilisms, - kā tiesiskās apziņas deformācijas veids”. Bakalaura izstrādes objekts ir tiesiskais nihilisms. Šīs deformācijas veids izpaužams izteikti negatīvā attieksmē pret likumiem, to vērtību nesaskatīšanā vai noliegšanā. Tieši tiesiskā nihilisma ietekme ir spējīga apturēt vai kavēt valstiskās nozīmes tiesisku pasākumu un reformu norisi. Bakalaura darba izstrādes procesā tika : •atklāta tiesiskā nihilisma jēdziena būtība; •izskatīts tiesiskais nihilisms kopā ar citām tiesiskās apziņas deformācijas veidiem; •veikta tiesiskā nihilisma klasifikācija; •noteiktas izpausmes formas un līmeņi; •aplūkots un analizēts tiesiskā nihilisma izpausme Latvijā. Darbs ir sadalīts trijās galvenās daļās: pirmā daļa balstās uz teorētisko pamatu, kur tika analizēti zinātniskā literatūra, zinātniskie raksti, mācību grāmatas, tiesību žurnāli; otrā darba daļa balstās uz empīrisko datu analīzi un interpretāciju; trešā daļa balstās uz darba gaitā izvirzītiem secinājumiem un ieteikumiem. Bakalaura darba struktūra sastāv no ievaddaļas, četrām pamat nodaļām, kopsavilkuma, izmantoto avotu un juridisku aktu saraksta un diviem pielikumiem.

The bachelors work «Legal nihilism, as the legal consciousness of deformation mode» main objective is the negation of rights in a legal consciousness. That means that the behavior rule systems can successfully control people relationships that are known as the social institution. The legal nihilism is based on the negation of laws which can lead to illegal actions and influence law system. The legal nihilism can be active and passive; connected with ignorance of law, where social role of right is denied. At the same time you can see the legal nihilism either in people who are closely connected to deterrent of law or scientific men. The bachelor’s work aims are investigation of structure of legal nihilism, it’s modes determination and showiness of how it influences the law-governed state. The great attention is given to the consequences of legal nihilism. Work consists of 3 main parts: 1)Theoretical part is based on theory, where were analyzed different scientific writings, legal literature; 2)Practical part is based on sentence and statistic analyze, which display legal nihilism in court system; 3)The third part of the work includes conclusions and recommendations of overcoming the reasons that cause the problem under research. Structure of given work includes an introduction, four chapters, conclusions, list of used literature and two supplements.
