Kopēja korupcijas jēdziena definējuma nav. Valstis un starptautiskie orgāni korupcijas jēdzienu un tā kukuļošanas jēdziena sastāvu izprot dažādi. Atšķirības ir novērojamas arī subjekta izpratnē. Darbs veltīts prettiesiskas labuma pieprasīšanas un pieņemšanas sodāmības, ko izdara valsts vai pašvaldības iestādes darbinieks, kas nav amatpersona, izpētei.
Darba gaitā iezīmējas atšķirības starp starptautisko korupcijas regulējumu, ārvalstu kriminālkodeksiem un Krimināllikumu. Tiek analizētas jēdzienu atšķirības un izteikti ieteikumi kā pilnveidot pašlaik koruptīvās darbības regulējošās normas. Tiek analizēts kā izpaužas objekts koruptīvajās darbībās, kas atrunātas pētāmajā Krimināllikuma 326.2 pantā, kā arī vispārējie cilvēktiesību pārkāpumi.
Darbs sastāv no 4 nodaļām. Katrā nodaļā konkrētā koruptīvā rīcība tiek aplūkota no dažādiem aspektiem. Pirmajā nodaļā tiek akcentēts kā normā paredzētais noziedzīgais nodarījums tiek regulēts starptautiski. Otrajā nodaļā ir analizēts konkrētais noziedzīgais nodarījums pēc tā sastāva, salīdzināts ar citiem Krimināllikuma pantiem ar saskanīgiem sastāviem. Analizējot ir pievērsta uzmanība arī pastāvošajai tiesu praksei. Trešajā nodaļā tiek pētīts kā norobežot pētāmo noziedzīgo nodarījumu no citiem ar līdzīgiem sastāviem. Un ceturtajā daļā tiek analizēts kā šāda veida darbību kontrolē ārvalstu kriminālkodeksi. A common definition of corruption does not exist. Countries and international bodies tend to understand the concept of corruption and bribery differently. The differences can also be observed within the meaning of the subject. This research is devoted to the examination of the conviction for a request and acquirement of an unlawful benefit perpetrated by a state or local authority, who is not an official.
In the research the differences among the international legal anti-corruption frameworks, foreign penal codes and the Latvian Criminal Law were outlined. Paper analyzes the differences in concepts and makes recommendations on the improvement of the current regulatory norms of the corruptive activities. The study examines how the object gets stipulated in corruptive actions defined by the Article 326.2 of the Latvian Criminal Law, as well as in general human rights violations.
The work consists of four chapters. In each chapter the corruptive conduct is observed from different angles. The first chapter highlights how corruptive offence norms are regulated internationally. The second chapter performs an evaluation of the stock of the specific offense and compares it with other articles of the Latvian Criminal Law involving consistent compositions. Analysis then focuses on the existing case law. The third chapter explores how to delimit this study from other crimes of similar consistency. And the fourth chapter examines how such offences are controlled by foreign criminal code.
