Efektīva sabiedrības un indivīda tiesību un interešu aizsardzība ir viena no valsts pamatfunkcijām.
Nepilngadīgo noziedzība kā viena no noziedzības sastāvdaļām ir kriminoloģiska kategorija, kas izmantojama, lai raksturotu bērnu, kuru vecums ir no 14 līdz 18 gadiem, izdarīto noziedzīgu nodarījumu kopumu, tās tendences noteiktā laikā un teritorijā.
Būtiski ir apzināties, ka nepilngadīgā izdarītais likumpārkāpums kā sociāli deformēta uzvedība norāda, ka konkrētā bērna tiesības jau iepriekš tikušas pārkāptas un viņa intereses kādā brīdī nav ievērotas vai palikušas novārtā. Aprūpes trūkums, vecāku un citu pieaugušo vienaldzība, nevēlēšanās saprast un apmierināt bērna vajadzības noved viņu līdz likumpārkāpumu izdarīšanai. Bērns ir vainojams konkrēta noziedzīga nodarījuma izdarīšanā, savukārt, valsts un sabiedrība – tādu apstākļu radīšanā, kuros bērns nolemj risināt savas problēmas uz citu personu un sabiedrības rēķina, pārkāpjot krimināltiesiskos aizliegumus.
Bakalaura darbs „Nepilngadīgo noziedzība” sastāv no ievada, četrām nodaļām ar apakšnodaļām, kopsavilkuma un pielikumiem.
Pirmajā nodaļā tiek dots nepilngadīgo noziedzības vispārējais raksturojums un analizēti statistikas dati. Otrajā nodaļā tiek atspoguļots nepilngadīgo personu sociāli demogrāfiskais un kriminoloģiskais raksturojums. Trešajā nodaļā tiek pētīti nepilngadīgo noziedzīgo nodarījumu faktori, kas saistīti ar sociālo vidi (ģimene, skola, neformālā vide) un pusaudžu vecumposma īpatnībām. Savukārt, ceturtajā nodaļā tiek analizēta patreizējā sodu sistēma nepilngadīgajiem un izstrādāti ieteikumi nepilngadīgo noziedzības novēršanai.
Darbā izmantoti LR normatīvie akti, 39 literatūras avoti, interneta resursi, speciālistu intervijas, nepilngadīgo anketēšana.
Darba apjoms ir 64 lapaspuses, tajā ir 8 tabulas un 4 pielikumi. Efficient protection of rights and interests of the society is one of the basic functions of the country.
Juvenile criminality as a component of the criminality as such is one of categories of criminology, which can be used to describe the totality of violations done by a child at the age from 14 to 18, and tendencies in particular time and territory.
It is important to realize that violation done by juvenile as a socially deformed behaviour indicates that the rights of the particular child has been abused previously, and its interests has not been taken into account or has been neglected. The shortage of care or disinterest from parents or other adults, unwillingness to understand and satisfy the needs of the child leads him to committing crime. The child is guilty for committing the particular crime, but the country and society – for creating such conditions, in which the child decides to take care of its problems on society’s or other person account, by violating criminal prohibitions.
The Bachelor’s Paper Juvenile Criminality consists of introduction, four chapters with sub-chapters, summary and appendices.
In the first chapter the Author characterizes the juvenile criminality in general and analyses statistical data. In the second chapter the Author describes the socio-demographic and criminological characteristic of the juveniles. In the third chapter the Author does a research of factors of juvenile’s criminal offence that are related to their social environment (family, school, informal environment) and features of teenagers’ age. In the fourth chapter the Author analyses the instant penalty system for juveniles and develops suggestions for elimination of juvenile criminality.
In this Paper the Author uses laws and regulations of Republic of Latvia, 39 sources of literature, sources of internet, interviews with specialists and surveys.
The amount of the Work is 64 pages, including 8 tables and 4 appendices.
