Administratīvo pārkāpumu lietu izskatīšana Valsts ieņēmumu dienestā.

Abstract

Bakalaura darba „Administratīvo pārkāpumu izskatīšana Valsts ieņēmumu dienestā” tiek izstrādāts uz 68 lappusēm. Pētīšanai tika izvirzīti sekojošie problēmjautājumi: •ilgstoša un maznozīmīga administratīvā pārkāpuma jēdziena atšķirīgā izpratne; •problēmas subjekta noteikšanā, nosakot administratīvo atbildību; •procesuālo normu regulējums administratīvo pārkāpumu lietās sakarā ar administratīvo pārkāpumu un administratīvās justīcijas nesavienojamību. Bakalaura darbs sastāv no četrām nodaļām un trīs pielikumiem. Darba pirmajā nodaļā tika raksturota VID kompetence administratīvo sodu piemērošanā, dots administratīvo pārkāpumu lietvedības VID vispārīgs apraksts, un identificētas problēmas, ar kurām sastopas VID amatpersonas izskatot administratīvo pārkāpumu lietas. Darba otrajā nodaļā tika analizēts ilgstošs pārkāpums un noteikta tā definīcija, kā arī izpētīts maznozīmīgs pārkāpumus un noteikti maznozīmīgā pārkāpuma kritēriji kopsakarā ar lietvedību administratīvā pārkāpuma lietā nepieļaujošiem apstākļiem. Trešajā nodaļā autore noskaidroja amatpersonas jēdzienu LAPK izpratnē, izanalizēja cik efektīva ir juridiskās personas administratīvā atbildība, un kādā veidā IK būtu saucams pie administratīvas atbildības. Ceturtajā nodaļā tika izvirzīta administratīvo pārkāpumu lietas procesuālas kārtības jauna regulējuma struktūra un noskaidroti personas par nodokļu pārkāpumiem dubultas sodīšanas gadījumi.

The bachelor work “The hearing of the administrative offences cases in the State Revenue Service” consists of 68 pages. The author set following questions to make a study of: •the diverse understanding of the long-term and minor administrative offences; •the problem of the entity identification of the administrative offence; •the procedural regulation of the administrative offences due to the incompatibility of the administrative offences and administrative justice. The work consists of the four parts and three appendixes. The first part of the work introduces with the State Revenue Services’s (further - SRS) competence of the hearing of the administrative offences and imposing a fine, consists the general description of the proceedings of administrative offences in the SRS, and the problems of SRS’s officials because of the mentioned above proceedings. The second part includes the analysis of the long-term and minor administrative offences. Author has defined the long-term administrative offence for the purpose of Latvian Administrative Violation Code, and investigated four criterions of minor administrative offences due to the SRS’s officials could not to institute proceedings of the administrative offence. The third part of the work gives review of the concept of officials as the offender of the administrative offence for the purpose of Latvian Administrative Violations Code. The third part includes also the analysis of the legal person’s guilt and administrative ability of the individual commercials. The fourth part of the work consists of author’s proposal of the possible structure of the procedural act of the administrative offences cases and investigation result of the cases, when person had been punished twice for the same offence.
