Uzturlīdzekļu piedziņa par labu bērniem

Abstract

Bakalaura darba temats ir „Uzturlīdzekļu piedziņa par labu bērniem.” Darba ievadā pamatota izvēlētā temata aktualitāte, pamatoti uzsverot, ka bērnu tiesību ievērošana un realizēšana, uzturlīdzekļu nodrošināšanas pienākums un to piedzīšana, ir aktuāli jautājumi šodienas sabiedrībā, kā arī Latvijas tiesību sistēmā pastāvošās materiālo un procesuālo normu nepilnības bērnu uzturlīdzekļu piedziņas jautājumos rada grūtības bērnu tiesību realizēšanā un nodrošināšanā. Par darba mērķi izvirzīts – noskaidrot un atklāt uzturlīdzekļu piedziņas bērniem tiesiskās un procesuālās problēmas Latvijas Republikas un ārvalsts normatīvos aktos, izdarīt secinājumus un sniegt apzinātu tiesisko un praktisko problēmu vai neskaidrību iespējamos priekšlikumus. Bakalaura darba 1.nodaļā „Uzturlīdzekļu būtība” tiek apskatīta uzturlīdzekļu jēdziena attīstība, uzturlīdzekļu maksāšanas pienākumus vecākiem un vecvecākiem, kā arī likumā paredzētās sankcijas par uzturlīdzekļu maksāšanas pienākuma nepildīšanu. 2. nodaļā „Uzturlīdzekļu piedziņa tiesas ceļā” tiek pētītas ar prasības pieteikuma iesniegšanu tiesā saistītās problēmas, uzturlīdzekļu apmēra noteikšanas principi, analizējot šo kritēriju atspoguļošanu Latvijas tiesu praksē, kā arī sniedzot ieskatu par Vācijas tiesībās pastāvošajām vadlīnijām uzturlīdzekļu apmēra noteikšanā un tiesas sprieduma par uzturlīdzekļu piedziņu izpilde. Darba 3. nodaļā „Uzturlīdzekļu Garantijas fonda darbība” tiek aplūkota Uzturlīdzekļu garantijas fonda kompetence, uzdevumi, sniegts ieskats par statistikas datiem, kā arī vērtēta izveidotās iestādes nepieciešamība un tās nozīmīgums sabiedrībā. Bakalaura darba 4. nodaļā „Uzturlīdzekļu piedziņa ārvalstīs” tiek pētīts uzturlīdzekļu piedziņas institūts ārvalstīs, proti, Krievijā un Lietuvā, kā arī sniegts salīdzinājums ar Latvijas Republikas tiesību sistēmu un Krievijas, Lietuvas tiesību sistēmā ietverto regulējumu par uzturlīdzekļu piedziņu, norādot kopējās un atšķirīgās iezīmes. Bakalaura darba kopsavilkumā formulēti pētījuma rezultāti un izteikti darba autores priekšlikumi bērnu uzturlīdzekļu piedziņas uzlabošanai un pastāvošo problēmu risināšanai.

The theme of the bachelor is: „Enforcement of children maintenance payments”. The introduction is based on the selected topic urgency, correctly is pointed out children's rights and it’s implementation. Maintenance and security, responsibility to recover, an issue’s in today’s society, as well as the Latvian legal system of existing material and procedural provision, shortcomings in child maintenance enforcement issues causing difficulties in exercising the rights of children and safeguarding. On forward view - to find and detect the recovery of maintenance for children of legal and procedural problems in Latvian and foreign laws, regulations, draw conclusions and make informed legal and practical problems of confusion or possible proposals. Chapter 1 "Essence of maintenance" discusses the maintenance concept development, maintenance obligations of parents and grandparents, as well as statutory penalties for failure to comply with maintenance obligations. Chapter 2 "Maintenance enforcement through the court" investigates the application on court problems, the amount of maintenance principles for determining the analysis of these criteria’s are reflected in the Latvian court practice, as well as providing in the German law, the existing guidelines for the maintenance determination and judicial decision in a maintenance enforcement. Chapter 3 "Maintenance Guarantee Fund" is devoted to the Maintenance Guarantee Fund, the competence, tasks looks at the statistics and assess the need to establishes institutions, and it’s importance’s in the society. Chapter 4 "Enforcement of maintenance in foreign countries" studied the recovery of maintenance institute abroad namely in Russia and Lithuania, and also provides a comparison with the Latvian legal system, Russian, Lithuanian legal system contains rules for maintenance, including the common and distinctive features. Bachelor thesis contain the results of research and the author’s propositions for the improvement of enforcement of children maintenance and solution of the existing problems.
