Uzturlīdzekļu piedziņa

Abstract

Uzturlīdzekļu sniegšanas pienākums vēsturiski, vienmēr bijis morāls pienākums, laba apziņa rūpēties par sev tuviem cilvēkiem. Strīdi par uzturlīdzekļu nodrošināšanu bērnam risināmi tiesā, gadījumā, ja puses nespēj savstarpēji vienoties. Uzturlīdzekļu piedzinēji, ja atbildētāji labprātīgi nemaksā tiesas piespriestos uzturlīdzekļus, var izmantot savas tiesības un izpildu dokumentu iesniegt piedziņai tiesu izpildītājam. Ja uzturlīdzekļus tiesu izpildītājs nevar piedzīt, izsniedz piedzinējam izziņu par uzturlīdzekļu piedziņas neiespējamību. Bērna vecāks ar šo izziņu var vērsties Uzturlīdzekļu garantijas fondā, lai saņemtu uzturlīdzekļu apmēru atbilstoši Ministru kabineta valstī noteiktajam minimālajam uzturlīdzekļu apmēram. Uzturlīdzekļu izmaksas bērniem, pēc 18 gadu vecuma sasniegšanas Uzturlīdzekļu garantijas fonds neparedz. Sākot ar 2010. gada 01. janvāri izmaksājamais uzturlīdzekļu apjoms katram bērnam no Uzturlīdzekļu garantijas fonda līdzekļiem tika samazināts, jo domājams, tas ir saistīts ar ekonomiskās krīzes apstākļiem valstī. Valsts budžetā ir nepietiekoši daudz finansējuma, lai izmaksātu uzturlīdzekļus Ministru Kabineta noteiktajā apjomā. Pēc Uzturlīdzekļu garantijas fonda interneta vietnes datiem šobrīd uzturlīdzekļus no valsts saņem 22 tūkstoši bērnu, gadā ir izmaksāti aptuveni 9 miljoniem latu. Uzturlīdzekļu parādnieku reģistrā iekļauts 21 tūkstotis personu, kurām nāksies atmaksāt valstij viņu vietā izmaksātos uzturlīdzekļus, jo šādam parādam noilguma nav. Uzturlīdzekļu garantiju fonda administrācijas un tiesu izpildītāju darbības, saistībā ar informācijas pārbaudi attiecībā uz parādnieka mantisko stāvokli, dažas pozīcijās nav saskaņotas un tiek dublētas. Lai zināmā mērā atvieglotu uzturlīdzekļu piedziņas procesu, bērna uzturlīdzekļu prasītājai, būtu nepieciešams vairāk izmantot likumos paredzētos nodrošinājumus: prasības nodrošinājums, hipotēka. Ja šie nodrošinājumi tiktu vairāk izmantoti, domājams valstī mazāk būtu uzturlīdzekļu parādnieki un arī tiesu izpildītājam būtu vieglāk piedzīt uzturlīdzekļus. Darbā tika apskatīts arī uzturlīdzekļu institūtu regulējums Igaunijā, Lietuvā kā arī neliels ieskats citu Eiropas valstu regulējumos. Analizējot citu valstu pieredzi un tiesisko regulējumu uzturlīdzekļu jomā, Latvijā būtu realizējami šādi priekšlikumi: Vajadzētu, lai tiesa varētu noteikt maksāt mazāku uzturlīdzekļu apmēru, nekā paredzēts Ministru kabineta noteikumos, ja atbildētājam ir objektīvs iemesls. Normatīvos aktos noteikt stingrākas sankcijas par uzturlīdzekļu nemaksāšanu.

The Aim of the Paper: research, how persons use rights to receive maintenance, set in regulations and what problems meet the institutions, involved in the recovery. Historically, the liability of delivering maintenance has always been ethical responsibility, the sense of duty of taking care of people near you. Disputes about providing maintenance to a child usually are arbitrated in court, in case Parties fail to come to an agreement in some other way. The collector of child support can use their rights and hand in the letter, notifying the collection, to the executor, if respondent refuse to pay the fine. If the executor cannot collect maintenance, the government provides the parent of the children the opportunity to turn to Administration of the Maintenance Guarantee Fund, to receive maintenance corresponding to the minimum amount of maintenance, set by The Cabinet of Ministers. Since the 1st of January, 2010 the amount of maintenance from the Maintenance Guarantee Fund for each children was reduced, it could be related to the economic crisis in the country and the measures of the state budget consolidation. Some actions of the Administration of the Maintenance Guarantee Fund and law enforcement officers, related to the verification of the information about the debtor's financial situation are not concerted or are duplicated. To facilitate, to a certain extent, the process of the recovery of the maintenance, the claimant of the child support should more often use the guarantees set by legislation: guarantee of claim, mortgage, and, in case of malice, request to apply criminal sanctions. If these guarantees were used more often, there would be smaller amount of maintenance debtors in the country, and it would be much easier for law enforcement officers to recover a debt. In the Paper the Author took a closer look at regulations of maintenance issue institutions in Estonia, Lithuania, and a smaller look at regulations of other European countries. After analysis of experience and legal regulations in maintenance issues in other countries, in Latvia there should be implemented such suggestions: 1.Give the rights to the Court to determine smaller amount of the maintenance than set in regulations set by the Cabinet of the Ministers, if the respondent has got justifiable reasons. 2. Set stricter sanctions in the legislation for non-payment of maintenance.
