Dienesta pilnvaru pārsniegšana

Abstract

Šis bakalaura darbs ir par dienesta pilnvaru pārsniegšanu un tās krimināltiesiskiem aspektiem. Darbā var iepazīties ar dienesta pilnvaru pārsniegšanas attīstību sākot no 1903.gada Sodu likuma līdz mūsdienām kā arī ar ārzemju tiesību aktiem, kas regulē dienesta pilnvaru pārsniegšanu. Tika noskaidrots noziedzīga nodarījuma subjekts kā arī noziedzīga nodarījuma sastāvs. Darbā tika noskaidrots, ka subjektu loks ir diezgan plašs un tāpēc jomas kurās var pārsniegt dienesta pilnvaras neaprobežojas tikai ar valsts pārvaldi. Darba rezultātā tika iegūtas pamatīgas zināšanas par dienesta pilnvaru pārsniegšanu kā arī par to kā Latvijas tiesās tiek definēti šādi noziedzīgi nodarījumi.

The study of these bachelor theses are related to misconduct and its relation to criminal law. The study presents historical development of misconduct since the year 1903 till nowadays as well as it covers foreign legislative acts relating to misconduct. The subject of offence and its components of crime were explored. The study concluded that the range of subjects is relatively broad and therefore the field of misconduct is not limited to government level. The research leads to profound knowledge of misconduct as well as how the courts in Latvia define this kind of crime.
