Pratināšanas kriminālistiskie aspekti

Abstract

Ivetas Urgas diplomdarbs „Pratināšanas kriminālistiskie aspekti” veltīts šīs visizplatītākās izmeklēšanas darbības aktuālajām problēmām. Autore veikusi pētījumu gan izmantojot savu praktisko pieredzi, gan intervējot kolēģus- policijas izmeklētājus, gan pētot apjomīgu teorētisko materiālu bāzi, lai risinātu galveno problēmu, paaugstinātu šīs izmeklēšanas darbības efektivitāti. Darbs sastāv no trīs nodaļām, kurās pakāpeniski analizēti šādi jautājumi: 1)Pratināšanas pierādīšanas nozīme un tās vieta notikuma izmeklēšanas struktūrā; 2)Pratināšanas taktika- vispārējās prasības, pratināšanas priekšmets, tās dalībnieki, tehniskais nodrošinājums un rezultātu fiksācija; 3)Pratināšanas taktiskie paņēmieni. Darbā parādīts, ka, lai gan pratināšana ir jebkura notikuma izmeklēšanas svarīga sastāvdaļa, tomēr tai nepiemīt īpašs pierādījuma spēks. Vislielāko efektivitāti pratināšana iegūst tad, ja tās gaitā iegūtie dati kļūst par pierādošās informācijas, kura iegūta no citiem avotiem, sastāvdaļu. Tāpēc izmeklētājam, plānojot pratināšanu, skaidri jāapzinās, kādam jābūt kopējam izmeklēšanas algoritmam (struktūrai), tas ir, kādas izmeklēšanas darbības un ar kādiem rezultātiem jau veiktas, un kādas vēl jāveic; kādā veidā ziņas, kas iegūtas pratināšanas laikā, jāizmanto nākamajās izmeklēšanas darbībās. Izpētīts kādi apstākļi ietekmē pratināšanas priekšmeta noteikšanu, uzdoto jautājumu pilnīgumu un to kārtību. Norādīti gadījumi, kad speciālistu piedalīšanās pratināšanas sagatavošanā un veikšanā, ir obligāts nosacījums tās efektivitātei. Skaidrots pratināšanas taktiskā paņēmiena jēdziens un parādīti pieļaujamās izmeklētāja psiholoģiskās iedarbības uz pratināmo, tā apstākļi un robežas.

The diploma paper “Forensic Aspects of Interrogation " by Iveta Urga deals with the most topical problems faced in investigation process. The author has carried out a study by using her own practical experience and by interviewing her co-workers - police investigators, as well as by studying theoretical resources. This has been done with the aim to solve the main problem- to increase the efficiency of the investigation. The paper consists of three chapters that analyze the following issues: 1) to prove the importance of interrogation and its place in the structure of an investigation event; 2) interrogation tactics, general requirements, subject of interrogation, its members, technical support and fixation of results; 3) tactical means of interrogation. The paper shows that although the interrogation is an important part of every investigation process, nevertheless it has no strong evidential value. An interrogation has the highest efficiency if the data acquired during the interrogation become a part of probative information obtained from other sources. Therefore, when an investigator plans an interrogation he must be clearly aware of what the common investigation algorithm (structure) should be, namely what investigation activities have already been carried out and what results have been achieved, and what is still to be done, how the information obtained during the interrogation should be used in investigation activities in the future. It has been studied what factors affect the determination of a subject for interrogation, the completeness of the questions asked and their sequence. The cases when experts have to be involved in the preparation and carrying out of an interrogation process have been stated, as their participation is a compulsory condition for an effective interrogation. The concept of interrogation tactics, permissible psychological effects of an investigator on a person being interrogated, and its conditions and limits have been explained.
