Cietsirdība un vardarbība pret nepilngadīgo izpratne un īpatnības

Abstract

Bakalaura darba tēma ir „Cietsirdības un vardarbības pret nepilngadīgo izpratne un īpatnības”. Bakalaura darbs sniedz raksturojumu cietsirdīgas un vardarbīgas izturēšanos pret nepilngadīgo tiesisko regulējumu, ko ir paveikušas personas, no kurām nepilngadīgais ir materiāli vai citādi atkarīgs. Bakalaura darbs sastāv no četrām nodaļām. Pirmajā nodaļā tiek izpētīts bērnu tiesību aizsardzības starptautiskais regulējums. Otrā nodaļā ir apskatīta vardarbības pret nepilngadīgo vēsturiskā attīstība Latvijas teritorijā kopš 1903.gada. Trešajā nodaļā tiek salīdzināts Krimināllikuma regulējums attiecībā uz nepilngadīgo aizsardzību pret vardarbību ar citu valstu likumiem. Ceturtajā nodaļā tiek veikta Krimināllikuma 174.panta juridiskā analīze, kur tiek aplūkota vardarbības un cietsirdības izpausmes. Bakalaura darba izstrādes gaitā tika izanalizēti dažādi materiāli, literatūra, tiesu prakse atbilstoši bakalaura darba tēmai.

The topic of the Bachelor project is "Cruelty and violence against minor; understanding and individuality". Bachelor project gives the characteristics and explanation of cruel and violent treatment against minor legislation regulation, which has made the persons from whom the minor is financially or otherwise dependent. Bachelor project consists of four chapters. The first chapter is investigating children's rights protection international regulation. The second chapter deals with violence against minors in historical development of the Latvian territory since 1903. The third chapter compares the criminal law regulation of protection of minors against violence in relation to legislation of the other countries. The fourth chapter carries out legal analysis of the Criminal Law Article 174, which is dealing with violence and cruelty expressions. During the development of Bachelor project author was analyzing different materials, literature and jurisprudence according to the Bachelor's topic.
