Disciplināratbildība Nacionālajos broņotajos spēkos.

Abstract

Autora izvēlētā bakalaura darba tēma – „Disciplināratbildība Nacionālajos broņotajos spēkos”, kuras aktualitātes pamatā ir ne tikai militārpersonu īpašais statuss un atbildība, bet arī masu saziņas līdzekļos paustais, ka bruņotajos spēkos ir notikuši vairāki ārkārtas notikumi dažādās jomās: apmācībā, ieroču un munīcijas glabāšanā un uzskaitē, starptautiskajās operācijās u.c., kas izraisījuši plašu rezonansi sabiedrībā par militārā dienesta organizāciju un disciplīnas stāvokli bruņotajos spēkos. Par bakalaura darba mērķi autors izvirza aktualizēt jautājumus, kas skar karavīru disciplināratbildības institūta teorētisko un praktisko raksturojumu, lai parādītu tā tiesisko dabu, un militārās disciplināratbildības būtiskāko pazīmju un elementu analīzi. Tādēļ šajā pētījumā var uzskatīt par svarīgu raksturot militārās disciplīnas nozīmīgumu. Bakalaura darba struktūru veido trīs nodaļas un apakšnodaļas. Darba pirmajā nodaļā autors atklās karavīru disciplināratbildības būtību un nozīmi un disciplinārpārkāpuma tiesiskos aspektus. Otrajā nodaļā autors analizēs disciplinārlietu izmeklēšanas normatīvo regulējumu, izvērtēs disciplināratbildības tiesiskos aspektus un aktualizēs administratīvā procesa principu jēgu un būtību pareizākai piemērošanai, kā arī akcentēs problemātiskos jautājumus karavīru militārajā disciplīnā un ar to saistītajās disciplinārlietās, kas skar disciplinārlietu procesuālo dabu. Pēdējā trešajā nodaļā autors raksturos administratīvo tiesu praksi un parādīs vispārējās tendences disciplinārsodu piemērošanā un lēmuma pārsūdzēšanā. Darba beigās doti secinājumi un priekšlikumi par aplūkojamo tēmu.

Author selected bachelor work – „Disciplinary responsibility in the National Armed Forces”, which is based not only on military special status and responsibility, but also the media expressed that in the armed forces have been a number of extraordinary events in different areas: training, weapons and ammunitionstore and accounting, international operations, etc., which caused a wide resonance in the society of military service organisation and status of discipline in the armed forces of the state. For bachelor work aim the author raises issues of military disciplinary responsibility institute of theoretical and practical nature, to show its legal nature, and essential characteristics and elements analysis of military disciplinary responsibility. Therefore, this study can be considered important to characterise the importance of military discipline. Bachelor work is structured in three chapters and subchapters. In the first chapter the author will open soldiers’ disciplinary responsibility nature and importance, and legal aspects of disciplinary negligence. In the second chapter the author will analyze the regulatory framework of the disciplinary investigation, will assess the legal aspects of disciplinary action and will bring the principle, the spirit and essence of correct application of the administrative process, as well as will emphasize issues of concern of soldiers’ military discipline and related disciplinary matters involving disciplinary procedural nature. Recently in the third chapter the author will characterize the practice of administrative courts and will show the general trend of disciplinary action and decisions. The end of work presents the conclusions and proposals of the relevant topic.
