Darbā analizēta dzīvojamo telpu īres maksas noteikšanas un grozīšanas kārtība Latvijas Republikā. Analizēta tiesu prakse, kas saistīta ar dzīvojamo telpu īres maksas noteikšanu un grozīšanu, konstatētas galvenās problēmas un sniegti priekšlikumi dzīvojamo telpu īres maksas noteikšanas un grozīšanas normatīvā regulējuma pilnveidošanai.
Par galveno problēmu atzīstams šobrīd nepietiekamais un sociāli ekonomiskajiem apstākļiem neatbilstošais dzīvojamo telpu īres tiesiskais regulējums. Tiesu praksē dzīvojamo telpu īpašnieku ar likumu aizsargātās intereses tiek nepamatoti ierobežotas. Otra būtiska problēma ir tirgū joprojām pastāvošais ievērojamais īres attiecību daudzums, kas nav noformētas ar rakstisku īres līgumu un tiesu prakse apstiprina šādu attiecību leģitimitāti, kā arī neadekvāti ilgais strīdus izskatīšanas laiks tiesās. Minētās problēmas aizskar ar likumu pamatoto izīrējamo telpu īpašnieku intereses; kavē ekonomiski pamatota īres tirgus attīstību un nodara kaitējumu gan konkrētu īpašumu sakopšanai un attīstībai, gan tautsaimniecībai kopumā.

The Paper analyses the procedures for fixing and adjustment of rent for residential premises in the Republic of Latvia. It includes an analysis of the judicial practices related to fixing and adjustment of rent for residential premises, identifies the principal problems, and gives recommendations for improvements to the regulations for fixing and adjustment of rent for residential premises.
A key current issue is the insufficient regulatory system of rent for residential premises which does not correspond to the social and economic conditions. In judicial practices, the statutory interests of owners of residential premises are unreasonably limited. Another essential issue is the amount of rental relationships on the market without a written lease or rental agreement, and the judicial practices confirm legitimacy of such relationships, as well as the inadequately long arbitration proceedings. The said issues affect the interests of owners of premises supported by the law; hinder development of economically justified renting market and have negative effects on maintenance and development of certain property and the national economy in general.
