Diplomdarba tēma ir „Pasažieru tiesību nodrošināšana aviopārvadājumos”. Diplomdarba mērķis ir noskaidrot, vai pasažieru tiesības aviopārvadājumos tiek nodrošinātas, vai tas ir paredzēts normatīvajos aktos un vai aviopārvadātāji tās ievēro. Svarīgi ir pārliecināties, ka pēdējo gadu laikā situācija aviācijā ir uzlabojusies un pasažieri netiek atstāti „likteņa varā”, ja no tiem neatkarīgu iemeslu dēļ tiek mainīti lidojumu apstākļi un laiki. Mērķis ir noskaidrot, vai likumdošanā ir iekļautas normas, kas aizstāv pasažieru tiesības, un ka ar laiku tiks darīts arvien vairāk, lai pasažieri justos pasargāti situācijās, kad pašu spēkiem kaut ko mainīt ir ļoti grūti.
Darba mērķa sasniegšanai autore ir izpētījusi starptautiskās konvencijas, Eiropas regulas, citus normatīvos aktus, teorētiskos materiālus, Latvijas nacionālās aviokompānijas AirBaltic praksi.
Tiek secināts, ka pasažieru tiesības pamatā tiek nodrošinātas, zaudējumi segti, par to liecina izskatītās lietas un pasažieriem izmaksāto kompensāciju apmērs, taču vēl „ilgs ceļš ejams”, lai pasažieris justos pilnībā pasargāts, izvēloties pārvietoties ar gaisa kuģiem. The theme of the diploma paper is „Provision of air transport passengers’ rights”. The objective of the diploma paper is to find out if the passengers’ rights are provided in the air transportation, if they are provided in the laws and regulations and if the air carriers observe them. It is important to ascertain that the situation in the aviation field has improved during the latest years and the passengers are not “left on their own”, if the flight conditions and time are changed due to the reasons with respect to them. The objective is to clarify, if the legislation includes the standards protecting the passengers’ rights and that by the time it is node more and more to make the passengers feel protected in the situations, when it is impossible to change something by own powers.
The author has examined the international conventions, European regulations, other laws and regulations, theoretical materials and the practice of Latvian national air company AirBaltic in order to achieve the objectives of the paper.
It is concluded that in the basis the passenger’s rights are provided, the damages are recovered, it is approved by the reviewed cases and the amount of remuneration paid to the passengers, however, “it is long way to go” before the passenger feels completely protected, choosing to move by the air ships.
