Administratīvās tiesvedības apturēšana personas vispārējās tiesībspējas zuduma gadījumā

Abstract

Bakalaura darbā „Administratīvās tiesvedības apturēšana vispārējās tiesībspējas zuduma gadījumā” darba autore analizē Latvijas Administratīvā procesa likuma 273.panta 1.punktā uzlikto pienākumu tiesai apturēt tiesvedību, ja ir mirusi fiziskā persona vai beigusi pastāvēt juridiskā persona, kas lietā ir pieteicējs vai trešā persona ar patstāvīgiem prasījumiem. Kaut arī pirmajā acumirklī norma šķiet vispār saprotama, problēmjautājumu, saistītu ar normas izpratni un piemērošanu, rodas visai daudz. Lai vispusīgi aplūkotu un izprastu darbam izvēlēto tēmu, darba autore ir secīgi uzskaitījusi un analizējusi likuma normā lietotos jēdzienus, izvērsti skaidrojot to nozīmi un lomu publisko tiesību nozarē. Tieši veicot šo jēdzienu un tiesību institūtu izpēti, darba autore ir saskārusies ar vairākiem problēmjautājumiem, kas rada neskaidrības minētās likuma normas piemērošanā.

In bachelor's work "Administrative suspension of the proceedings in case of loss of the general legal capacity", the author analyzes the Latvian Administrative Procedure Act Article 273 obligations imposed by paragraph 1 of the court to stay the proceedings if the individual died or ceased to exist a legal person in case of an applicant or a third party with independent claims. Although at first sight, the norm is generally understood, there is a whole lot issues related to the rules of interpretation and application. In order to comprehensively understand and see the work of the chosen theme, the author consecutively counted and analyzed the legal norm used concepts, explaining in detail the importance and role of the public sector. Just taking that concept and the research institute, the author has been faced with several challenges, which creates confusion in applying the provisions of the law.
