Šī darba galvenais mērķis ir izpētīt lietiska pierādījuma lomu kriminālprocesā
Darbs sastāv no trīm daļām. Pirmajā daļā tiek apskatīta „pierādījuma” jēdziena attīstība, ka arī tiek plašī aplūkoti pierādīšanas līdzekļi un pierādījumu klasifikācijas. Otrā daļā tiek pētīts „lietisko pierādījumu” jēdziena saturs. Trešā daļa ir praktiska, tur tiek analīzēta ricība ar lietiskiem pierādījumiem.
Praktiskā daļā tiek analizēti piemēri – tiesu spriedumi, kuru rezultātīva daļā ir noteikts, kas darāms ar lietiskiem pierādījumiem.
Tēmas aktuālitāte parādas tajā aspektā, kā bez lietisko pierādījumu pastāvēšanas daudzos gadījumos nevar uzzināt patiesību par noziedzīga nodarījuma apstākļiem.
Autore aplūko lietiskos pierādījumus kā patiesības izdibinātājus noziedzīgo nodarījumu izmeklēšana.
Izmantotas pētījumu metodes: teorētiskās izpētes metodes, analīze, salīdzināšana, apraksts un analogija.
Darba tika izmantota zinātniskā literatūra pierādījumu un lietisko pierādījumu jomā, raksti pereodikā un rakstu krājumos, prakses materiali un tiesību akti.
Bakalaura darbs satur: paskaidrojuma rakstu uz 54 lapam un 26 informācijas avotu nosaukumus. The purpose of this work is to research the role of physical evidence in the criminal proceeding.
The present work consists of three main parts. The development of the concept of ‘evidence’ is considered in the first chapter of the work. Also there are widely considered assets of evidence and evidence classification.
In the second chapter of this work the content of the concept “physical evidence’ have been researched. The analysis of the work with the physical evidences have been done in the third (practical) part of the present work. The examples of the judicial decision, which includes the actions that has to be taken towards the physical evidences have been considered in the practical part.
The topicality of the title shows that the physical evidence plays one of the most important roles of the criminal investigation.
The author of the present work have been considered the way of the criminal investigation by the physical evidence as a prober.
Theoretic research, analysis, comparison, description and analogy have been used as the research methods.
The scientifical literature in the field of physical evidence, periodic, legislative acts and practical material have been used in the present work.
The present research work consists of 54 pages and it has 26 sources of bibliography.
