De minimis atbalsta kumulēšanas aizliegums ar valsts atbalstu

Abstract

Šī bakalaura darba tēma ir De minimis atbalsta kumulēšanas aizliegums ar valsts atbalstu. Darba aktualitāte pamatojama ar ekanomiskās izaugsmes nepieciešamību, ko valsts atbalsts un de minimis atbalsta pareiza un ilgtermiņā vērsta pielietošana spēj sniegt. Šī darba mērķis ir veikt valsts atbalsta un deminimis atbalsta salīdzinājumu tā kumulācijas aizlieguma analīzi. Pirmajā daļā ir apskatīts valsts atbalsts jādziens, tā aizliegums un atļaujošie gadījumi. Tika apskatīta valsts atbalsta piešķiršanas kārtība un paziņošanas pienākums. Aplūkots prettiesisks atbalsts, esošā atbalstu sistēma, valsts atbalsta saskaņošana un atbalsta jēdzienu paskaidrojums. Otrajā daļā tika aplūkots de minimis atbalsts, tā veidošanās un tās ietvaros pilnvarojošā regula, de minimis regula un de minimis uzraudzības kārtība. Trešajā daļā tiek noskaidrots de minimis atbalsta kumulācijas aizliegums ar valsts atbalstu un tā nosacījumi, kā arī de minimis atbalsta kumulācijas sliekšņa kontrole.

The title of this bachelor thesis is “Prohibition of de minimis support cumulation by the State aid”. The current issue of thesis is based on the necessity of economical growth, which can be achieved with effective and long-term oriented State aid and de minimis support. The aim of bachelor thesis is to compare aid provided by the State and de minimis, as well as analyse prohibition of cumulation. To prove this statement the method of comparative cumulation analysis will be used. In the first Chapter a general description of the term State aid is given, describing cases where it is authorized or prohibited. Also legal procedures concerning distribution and obligation of publicity are described. More information on illegal aid, currently existing aid system, co-ordination of the State aid and explanation of terms used for aid description is provided. The second Chapter establishes the importance of de minimis aid, its development and authorized regulation within it, as well as regulation relevant to de minimis and monitoring of the de minimis enforcement. The third Chapter gives an overview of influence on prohibition of de minimis aid by the State aid and its conditions and also supervision of de minimis aid cumulation verge.
