Laulības šķiršana

Abstract

Bakalaura darba tēma ir „Laulības šķiršana”. Tēmas aktualitāte ir saistīta ar lielo laulības šķiršanas skaitu Latvijā. Mūsdienās ir raksturīgi slēgt laulību, neapzinoties sekas, kādas var iestāties, kad tā tiek šķirta, kad tiek dalīta manta un risinātie citi jautājumi saistībā ar laulības šķiršanu. Autore izvirzīja un sasniedza bakalaura darba mērķi - izanalizēt spēkā esošos normatīvos aktus, kas attiecās uz laulības šķiršanas institūtu, to piemērošanu, kā arī izpētīt un analizēt attiecīgu tiesu praksi Latvijā. Lai sasniegtu darba mērķi, tika izvirzītie šādi uzdevumi: •apskatīt spēka esošus likumus un to piemērošanu praksē; •noskaidrot vai likumdošana ir viegli saprotama, interpretējama un piemērojama praktiskajā darbā; •norādīt uz problemātiku laulības šķiršanas procesā. Bakalaura darbs sastāv no ievada, trīs nodaļām, kopsavilkuma, izmantotās literatūras, normatīvo aktu un tiesas prakses saraksta, kā arī pielikumiem. Darba izstrādes gaitā tika izmantoti literatūras avoti, normatīvie akti, publikācijas, interneta resursi, tiesas spriedumi, kā arī intervēta Rīgas pilsētas Kurzemes rajona tiesas priekšsēdētāja A.Orniņa un zvērinātā advokāte Ilva Žeire.

The theme of the bachelor`s work is „The divorce proceeding”. The actuality of this theme comes due to the large number of divorces in Latvia. Today, it is typical to marry without realizing the consequences that may occur if to divorce, when the property is divided and other related issues to divorce are solved. The author has defined and achieved the aim of the bachelor's work – to analyze the existing laws and regulations connected with the divorce process, its application, as well to explore and analyze the relevant Latvian court practice. For achieving the aim of the work, were establised the following tasks; •to look at the existing laws and their application in practice; •to clarify whether the law is easily understood, interpreted and applied in a practical work, •to indicate the problems of divorce proceedings The bachelor work consist of an introduction, three chapters, conclusions, a list of bibliography used, the list of legislation and judicial practice, as well the attachments. During the development of the work were used literature sources, different legislations, publications, web resources, court decisions, as well there were interviewed Riga Kurzeme District Court President A. Orniņa and attorney Ilva Žeire.
