Zaudējumu atlīdzināšana OCTA apdrošināšanā

Abstract

Bakalaura darbā tiek pētīti sauszemes transportlīdzekļu īpašnieku civiltiesiskās atbildības obligātās apdrošināšanas problēmjautājumi, attiecībā uz zaudējumu atlīdzināšanu trešajām personām, kas ir cietušas ceļu satiksmes negadījumā. Bakalaura darba mērķis ir apskatīt OCTA likumā esošās nepilnības attiecībā uz zaudējumu atlīdzināšanu trešajām personām, kā arī rast risinājumu esošajām problēmām. Darbā tiek apskatīta tiesu prakse, kā arī jaunie grozījumi OCTA likumā. Bakalaura darbs ir strukturēts trīs daļās. Darba pirmajā daļā tiek aplūkoti zaudējumi, kas var rasties CSNg rezultātā. Autore zaudējuma veidus iedala divās kategorijās personai un mantai nodarītie zaudējumi. Darba otrajā daļā tiek apskatīta zaudējumu pieprasīšanas un atlīdzināšanas kārtība, kā arī gadījumi, kad zaudējumi netiek atlīdzināti, atsaucoties uz konkrētiem gadījumiem un judikatūru. Darba trešajā daļā ir apkopota informācija saistībā ar regresa prasību, ko apdrošinātājs vai LTAB var vērst pret personu, kas CSNg nodarījusi zaudējumus trešajai personai. Bakalaura darba izstrādē autore izdara secinājumu, ka daļu no problēmjautājumiem likumdevējs ir novērsis, Saeimas ārkārtas sēdē apstiprinot grozījumus OCTA likumā. Tomēr ne visas problēmas, kas saistītas ar apdrošināšanas atlīdzības izmaksu un regresa prasības vēršanu ir atrisinātas.

Bachelor's are studied motor vehicle third party liability insurance issues, for damages to third parties who have suffered a road traffic accident. Bachelor's is to look at Traffic Law gaps for damages to third parties, and to find solutions to existing problems. Work is discussed in case law, as well as the new Traffic Law. Thesis is structured in three parts. The first part deals with the losses that may arise as a result the road accident. The author's been subdivided into two categories of person and property damage caused. The second part examines the loss and requesting reimbursement arrangements, as well as cases where the losses are not compensated by reference to specific cases and case law. In the third part summarizes the information related to recourse by the insurer or the MIB may be directed to the person who caused the traffic accident injury to a third party. Undergraduate work in developing the author concludes that some of the issues have been corrected by the legislature, special session of the Saeima approving amendments to the Traffic Act. However, not all problems related to the payment of insurance indemnity, and subrogation and targeting have been resolved.
