Kontrabandas krimināltiesiskie aspekti

Abstract

Bakalaura darbā tiek aplūkoti kontrabandas krimināltiesiskie aspekti, gūts ieskats krimināltiesiskajā regulējumā, analizēts kontrabandas jēdziens, kā arī tiesu prakse un regulējums citās valstīs. Šā darba mērķis - veikt kontrabandas krimināltiesiskā regulējuma analīzi un izvērtēt šā regulējuma problēmjautājumus. Analizējot veiktos un paredzētos grozījumus Krimināllikumā un tiesisko regulējumu citās valstīs, autore nonāk pie secinājuma, ka pastāv būtiski apsvērumi, kādēļ nevajadzētu paredzēt kriminālatbildību par atkārtoti gada laikā izdarītu kontrabandu. Tāpat arī autore secina, ka no kontrabandas sastāva jāizslēdz noziedzīgu nodarījumu atkārtotība, kā arī jāsamazina brīvības atņemšanas sodu minimālās un maksimālās robežas un jāpalielina brīvības atņemšanai alternatīvu sodu – naudas soda un piespiedu darba piemērošana.

In the Bachelor paper the author has studied criminal aspects of smuggling, gained insight into criminal regulations regarding responsibility for the smuggling. The aim of this paper is to analyse criminal regulation of the smuggling, and to evaluate the problematic issues. Analysis of the amendments of the Criminal Law adopted and envisaged, and regulations of the smuggling in other countries has leaded to the conclusion that there are great concerns about the legal aspects of the criminal responsibility for smuggling repeated during a year. Moreover, the author concludes that repeated crime should be excluded from the Criminal Law, as well as minimum and maximum boundaries of the imprisonment should be reduced and application of the punishment alternative to the imprisonment – fees and forced labour – should be increased.
