Laulāto līgumiskās mantiskās attiecības

Abstract

Darba tēma ir laulāto līgumiskās mantiskās attiecības. Darbs skar arī jautājumus par starptautiskās tiesiskās sadarbības problemātiku. Darba pirmajā nodaļā ir apskatītas laulāto līgumiskās mantiskās attiecības Latvijā. Otrajā nodaļā ir apskatīti laulāto savstarpējo mantisko attiecību regulējošie līgumi un to normatīvie regulējumi atsevišķās Eiropas Savienības valstīs, proti - Latvijā, Lielbritānijā, Francijā un Itālijā. Otrajā nodaļā, galvenokārt, tiek runāts par jautājumiem, kuriem būtu jāpievērš liela uzmanība attiecībā uz aprakstīto tēmu, padziļināti šie jautājumi ir aplūkoti un izpētīti trešajā nodaļā. Trešā nodaļa ir izpētītas laulāto mantisko attiecību regulējošo līgumu noslēgšanas sekas laulātajiem un trešajām personām, kā arī laulāto mantisko attiecību regulējošo līgumu ietekme uz laulības šķiršanas procesu Latvijā un atsevišķās Eiropas Savienības valstīs. Ceturtā nodaļā ir apskatīts jautājums par tiesisko sadarbību starp Eiropas Savienības dalībvalstīm, kā arī ir apskatīti Eiropas Savienības normatīvie akti, konvencijas un regulas. Tēmas pētīšanas rezultātā darbā ir izdarīti secinājumi un, balstoties uz veiktajiem secinājumiem, ir izvirzīti priekšlikumi.

The issue of paper is contractual matrimonial property regime. As well is discussed about international judicial co-operation issues. The first chapter addresses the questions of contractual matrimonial property regimes in Latvia. The second chapter deals with property relations between spouses regulating contracts in certain European Union countries, namely Latvia, Britain, France and Italy, and its legislative regulation. The second chapter mainly comes to issues on which should be paid great attention according to studied theme, in depth these issues are discussed and explored in the third chapter. In the third chapter is discussed about matrimonial property contracts its regulation and effects it may give on spouses and third parties, as well as discussed about matrimonial property agreement regulation effect on the divorce process in Latvian and in European Union certain countries. The fourth chapter discusses the question of the legal co-operation between the European Union member states that also deals with European Union laws, conventions and regulation. Work has resulted in a number of conclusions and recommendations.
