Kriminālatbildība par vardarbību un cietsirdību pret nepilngadīgo

Abstract

Pasaulē arvien vairāk bērnu tiek pakļauti cietsirdībai un vardarbībai, un Latvija nav izņēmums. No cietsirdības un vardarbības ir cietuši daudzi bērni - gan ģimenē, gan tie, kas atrodas valsts aprūpē. Bērna, tāpat kā ikviena cilvēka dzīvi sabiedrībā, viņa aizsardzību, tiesības un pienākumus nosaka daudzi starptautiskie dokumenti un Latvijas Republikas normatīvie akti. Starptautiskā un nacionālā līmenī ir noteikts bērna īpašs statuss sabiedrībā, kā arī norādīts uz to, ka valstij un sabiedrībai ir nepieciešams bērnu īpaši aizsargāt. Katram cilvēkam, īpaši amatpersonām, kuru kompetencē ir bērnu tiesību aizsardzība, ir jāzina pamatlikumi un pamattiesību normas, ir jāprot iztulkot un izprast tajās ietverto saturu, kā arī jāzina savi pienākumi un tiesības, jāprot tos ievērot, pielietot gan bērna, gan sabiedrības interesēs. Kriminālatbildība par vardarbību un cietsirdību pret nepilngadīgo paredzēta Krimināllikuma 174.pantā. Bakalaura darba mērķis ir izpētīt Krimināllikuma 174.pantu, kas paredz kriminālatbildību par cietsirdīgu vai vardarbīgu apiešanos ar nepilngadīgo vai mazgadīgo, ja ar to nepilngadīgajam vai mazgadīgajam nodarītas fiziskas vai psihiskas ciešanas un ja tās nodarījušas personas, no kurām cietušais ir materiāli vai citādi atkarīgs. Lai sasniegtu izvirzīto mērķi, tiek nosprausti sekojoši darba uzdevumi: 1. Lai pilnīgāk izprastu šo tiesību normu, analizēt kriminālatbildības par vardarbību un cietsirdību pret nepilngadīgo vēsturiskās attīstības tendences. 2. Tiesību normas un tiesu prakses analīze, vienlaicīgi norādot uz teorijas un prakses problēmjautājumiem. 3. Kriminālatbildības par vardarbību un cietsirdību pret nepilngadīgo analīze ārvalstu krimināllikumos. 4. Kopsavilkumā sniegt apkopojumu par darba izstrādes gaitā iegūto informāciju, apkopot darba izstrādes gaitā izdarītos secinājumus un norādīt piemērotākos risinājumus situācijas uzlabošanai.

More and more children in the world are being subjected to cruelty and violence, and Latvia is not an exception. Many children are victims of cruelty and violence - both at home and those in state care. Child’s life, like every human life in society, his protection of the rights and obligations are determined by many international documents and the Latvian legislation. International and national level provides the child's special status in society, as demonstrated by the fact that the state and the society have to protect children in particular. Everyone, especially officials with responsibilities for child protection, is familiar with basic laws and fundamental norms as well as must be able to interpret and understand the contents contained therein, and be aware of their responsibilities and rights, be able to follow them, to use both the child and the public interest. Criminal liability for the violence and cruelty against the juvenile for criminal law article 174. Bachelor thesis aims to investigate the Criminal Law 174, which provides criminal liability for cruel and violent treatment of juvenile or a minor if the juvenile or minor, inflicted to physical or mental suffering, and if they have caused by the persons from whom the person is financially or otherwise dependent. To achieve the goal set for the following tasks: 1.In order to understand the law more fully, analyze historical trends of criminal violence and cruelty to juvenile. 2.Legislation and case law analysis, while pointing to the theory and practice challenges. 3.Analysis of criminal liability for the violence and cruelty to juvenile in the foreign criminal law. 4.To give a conclusions in the summary about obtained information in the process of paper development, to collect the deductions and indicate the most appropriate solutions to improve the situation.
