Mājokļa neaizskaramības princips ir nostiprināts cilvēktiesībās, lai garantētu personai netraucētu šo tiesību izmantošanu. Praksē pastāv viedoklis, ka atsevišķos gadījumos starp tiesībām uz mājokļa neaizskaramību un tiesībām uz īpašumu pastāv kolīzija.
Tādēļ, autore aplūkos mājokļa neaizskaramības principu cilvēktiesību kontekstā. Izvērtēs gadījumus kad vienas personas tiesības uz mājokļa neaizskaramību var konfliktēt ar citas personas īpašuma tiesībām, turklāt izpētīs valsts atbildību un pienākumus attiecībā uz mājokļa neaizskaramības principa ievērošanu, lai izdarītu secinājumus par pastāvošo problemātiku Latvijas tiesiskajā regulējumā un praksē un šī regulējuma un prakses atbilstību starptautiskajām tiesībām. In practice, there is a view that, in certain cases, between the right to housing and the right to property there is a conflict of laws.
Therefore, the author will look at housing in the context of the principle of respect for human rights. Evaluate cases when one person's right to inviolability of the home may conflict with another person's property and will examine the national responsibilities and duties with regard to the principle of inviolability of the home, to draw conclusions about the existing problems of Latvian legislation and practice and that legislation and practice of compliance with international law.
