Laulāto atsevišķā manta laulāto likumiskajās un līgumiskajās mantiskajās attiecībās

Abstract

Bakalaura darbs „Laulāto atsevišķā manta laulāto likumiskajās un līgumiskajās mantiskajās attiecībās” izstrādāts, jo juridiskajā literatūrā un tiesu praksē pastāv atšķirīgi viedokļi par laulāto atsevišķās mantas sastāva noteikšanu un tās nošķiršanu no laulāto kopīgās mantas. Bakalaura darba mērķis un uzdevums ir analizējot juridiskajā literatūrā paustās atziņas, laulāto mantisko attiecību tiesisko regulējumu Latvijas Republikā un Latvijas Padomju Sociālistiskajā Republikā, gūt padziļinātu izprati par laulāto atsevišķās mantas sastāva saturu un būtību, un rast ieteikumus, lai uzlabotu šī brīža Latvijas regulējumu. Darba izstrādes gaitā, autore analizējot un salīdzinot normatīvos regulējumus, tiesu praksi un juridisko literatūru nonākusi pie secinājumiem par to, kāda manta ietilpst laulāto atsevišķajā mantā, kā arī akcentējusi atšķirības un nepilnības analizētajos normatīvajos regulējumos.

Bachelor thesis "Spouses separate property in spouses lawful and contractual property relations" is elaborated because in the legal literature and case law there are different views on the legal composition of the separate property and the separation of their common property. Bachelor thesis aim and mission is to analyze the legal literature, analyze matrimonial property legislation in Latvian Republic and the Latvian Soviet Socialist Republic and gain an in-depth awareness within the legal separate property composition content and nature, and to find recommendations to improve the current Latvian legislation. The authoress, who analyzed and compared laws, case laws and legal literature, has come to conclusion about the property which is included in separate property of the spouses, and highlighted the differences and gaps between analyzed regulations.
