Ģimenes institūts tiesību normās un tiesību realitātē Latvijā

Abstract

Plašās diskusijas Latvijas sabiedrībā par ģimeni, tās nozīmi un izpratni, kā arī dažādu nozaru pētniecība ar ģimeni saistītos jautājumos norāda uz šī institūta nozīmīgumu, kā arī uz to, ka par ģimenes jēdzienu nav vienprātīgas nostājas. Pētījuma mērķis ir noskaidrot ģimenes institūtu tiesību normās un tiesību realitātē mūsdienu Latvijā. Dažādu institūtu izpratne normatīvajos aktos un tiesību realitātē var atšķirties, tādēļ maģistra darbā izklāstīts, vai Latvijā vērojamas šādas atšķirības attiecībā uz ģimenes institūta izpratni, un pētīts, kā tiesību norma projicējas tiesiskajā realitātē un tiesiskā realitāte iekļaujas tiesību normās. Lai sasniegtu darbā izvirzītos mērķus, definēti šādi pētījuma uzdevumi: 1) izpētīt ģimenes institūta vēsturi, analizējot tiesību avotus pirms un pēc Latvijas Republikas dibināšanas, kā arī kanoniskās tiesības; 2) izpētīt ģimenes institūta regulējumu mūsdienu Latvijas tiesībās; 3) izpētīt ģimenes institūtu Eiropas Savienības tiesībās; 4) apzināt līdz šim nepētītās vai maz pētītās un aktuālās problēmas attiecībā uz ģimenes institūta izpratni; 5) apzināt ģimenes jēdziena izpratni tiesību realitātē. Reālās tiesiskās attiecības ne vienmēr sakrīt ar likumdevēja modelētām attiecībām, kas fiksētas spēkā esošajās tiesību normās. Tiesību realitāti veido cilvēku savstarpējo juridisko attiecību faktiskie modeļi. Sabiedrības izpratne par ģimenes institūtu bieži vien atšķiras no tiesību normās piedāvātajiem modeļiem, taču ne vienmēr nepieciešams ieviest jaunu tiesisko regulējumu, lai tas atbilstu sabiedrībā praktizētajiem attiecību modeļiem. Extensive public discussions in Latvia regarding the family, its meaning and understanding, as well as researches of various fields focusing on the family related issues indicate significance of this institution, as well as the fact that there is no unanimous position regarding the family concept. The goal of the research is to find out the family institution within the regulations and legal reality of nowadays Latvia. The understanding of various institutions reflected in the rules and regulations and legal reality may differ, therefore the Master Thesis sets out whether such differences regarding the understanding of the family institute are observed in Latvia, and it explores how the regulations are projected in legal reality and how it fits within the regulations. To achieve the goals set in the Thesis, the following research tasks are defined: 1) to study the history of the family institute by analysing legal sources before and after the foundation of the Republic of Latvia, as well as cannon law; 2) to study the regulation of the family institute within the existing law of Latvia; 3) to study the family institute in the European Union law; 4) to gather information regarding the current problems which are unexplored or little explored up to now and the understanding of the family institution; 5) to gather information regarding the understanding of the family concept in legal reality. Actual legal relationships do not always match the relationships modelled by the lawmakers and stated in the existing law. Legal reality is created by actual mutual legal relationship models of people. Public understanding regarding the family institution often differs from the models proposed by law, however, it is not necessarily to introduce a new legal framework in order to meet relationship models practised by society.
