Publiskais iepirkums kā preču pakalpojumu brīvas pārrobežu aprites veicināšanas instruments Eiropas Savienībā

Abstract

Publiskais iepirkums ir Eiropas Savienības vienotā (arī kopējā, iekšējā) tirgus veidošanas procesa daļa. Tāpēc svarīgi identificēt pārrobežu iepirkumu kavējošos šķēršļus preču, pakalpojumu un būvdarbu brīvai apritei un meklēt risinājumus to novēršanai. Bakalaura darba “Publiskais iepirkums kā preču un pakalpojumu brīvas pārrobežu aprites veicināšanas instruments Eiropas Savienībā” mērķis ir izstrādāt priekšlikumus iepirkumu regulējuma un tā piemērošanas pilnveidei Direktīvas 2014/24/ES kontekstā. Mērķa sasniegšanai izvirzīti uzdevumi analizēt publiskā iepirkuma vietu vienotajā tirgū un pārrobežu publisko iepirkumu veicinošos un ierobežojošos faktorus. Vienveidīgas piemērošanas veicināšanai nepieciešams tālāk pilnveidot regulējumu, Direktīvu 2014/24/ES papildinot ar ārpus Direktīvas tvēruma esošo pakalpojumu sarakstu, uzlabojot Vienoto iepirkumu vārdnīcu (CPV) un intensīvāk izstrādājot vadlīnijas, kritēriju sarakstus, preču aprites cikla izmaksu kalkulatorus un citus līdzekļus zaļā un sociāli atbildīgā iepirkuma veikšanai.

Public procurement is a part of the European Union's single (also common, internal) market-making process. It is therefore important to identify obstacles to cross-border procurement and free movement of goods, services and works and to look for solutions to them. The aim of the bachelor’s paper “Public Procurement as a Tool of Enforcement of Free Cross-Border Movement of Goods and Services in the European Union” is to develop proposals for improving the procurement framework and it’s application in the context of Directive 2014/24/EU. To achieve the goal the following tasks are set: to analyze the place of public procurement in the single market and the factors contributing and limiting cross-border public procurement. In order to promote uniformity of application, it is necessary to improve the regulation by supplementing Directive 2014/24/EU with a list of services outside the scope of the Directive, improving the Common Procurement Vocabulary (CPV), and more intensively developing guidelines, lists of criteria, life cycle cost calculators and other tools for green and socially responsible procurement.
