. The prohibition on financing the acquisition of its shares is established in Section 241 of the Commercial Law and applies to joint-stock companies, not to companies with limited liability. The funding ban has been taken over from the Second Directive of the Council, whose amendments regarding the abatement of the funding prohibition have not yet been transposed into Latvian national law. The aim of the paper is to analyze the most important issues and the need to introduce amendments to the Second Law of the Council into the Commercial Law. In order to avoid the eligibility of the financing ban for Limited Liability Companies, amendments to the Commercial Law need to be made, specifying the eligibility of the financing prohibition for joint-stock companies.
