dc.description.abstract | Maģistra darba tēma ir aktuāla mūsdienās saistībā ar globāla mēroga cīņu ar finanšu un ekonomiskajiem noziedzīgiem nodarījumiem, kā arī cīņu ar noziedzīgi iegūtiem līdzekļiem, kas tādējādi ir veicinājis arī konfiskācijas tiesību institūta attīstību. Savukārt uz notiesāšanu nebalstītu konfiskāciju (non-conviction based confiscation) var dēvēt par vienu no kriminālprocesa inovitātēm, kas pastāv līdzās mums jau zināmajai konfiskācijai ar notiesājošu spriedumu. Uz notiesāšanu nebalstītas mantas konfiskācijas process, kas ietverts Kriminālprocesa likuma (turpmāk - KPL) 59.nodaļā, pēdējos gados tiek plaši piemērots praksē, lai konfiscētu noziedzīgi iegūtus līdzekļus pirms galīgā nolēmuma pasludināšanas kriminālprocesā. Darba autore aplūko tiesību institūta - uz notiesāšanu nebalstītas mantas konfiskācijas būtību un saturu, kā arī šī tiesību institūta regulējumu Latvijas kriminālprocesa tiesībās, vienlaikus apzinot tiesību institūta darbību praksē un prakses problemātiku. Tiek vērtētā KPL 59.nodaļas attīstība, priekšnosacījumi KPL 59.nodaļas piemērošanai, kā arī aplūkots process par noziedzīgi iegūtu mantu izmeklēšanas iestādē un tiesā. Nobeigumā tiek aplūkota arī rīcība ar noziedzīgi iegūtu mantu pēc tiesas nolēmuma pasludināšanas. | |
dc.description.abstract | The chosen topic of the dissertation is topical in connection with a global fight against the financial and economic crimes as well as the fight against proceeds of crime. Therefore, it has affected development of confiscation institute of Law. Non-conviction based confiscation is one of the innovations in the Criminal Procedure Law that coexists with confiscation based on conviction. Non-conviction based confiscation process, which is included in the Chapter 59 of the Criminal Procedure Law, is widely used in practice for the confiscation of proceeds of crime before a final decision in criminal proceedings. The author examines the nature and content of the law institute – non-confiscation based confiscation, as well as the regulation of this law institute in Latvian criminal procedure law, at the same time examining the practice of the law institute and its problems. The author also examines development of the proceedings regarding criminally obtained property in the investigation institutions and in the court. At the end author takes a look at the actions with criminally acquired property after a court judgment. | |
