Pilngadīgu personu darījumspējas ierobežojumi un to tiesiskās sekas

Abstract

Bakalaura darba tēma ir „Pilngadīgu personu darījumspējas ierobežojumi un to tiesiskās sekas”. Tā kā darījumspēja var tikt atņemta vai ierobežota tikai likumā noteiktos gadījumos, autore savā darbā pēta darījumspējas jēdzienu, darījumspējas ierobežošanas mērķus un to, kādas tiesiskās sekas iestājas, ja pilngadīgai personai darījumspēja tiek atņemta vai ierobežota. Tāpat tiek pētīts arī aizgādnības jēdziens, aizgādnības nodibināšanas iemesli un sekas. Darba pirmajā nodaļā uzmanība tiek pievērsta pašam darījumspējas jēdzienam un tās subjektiem. Otrā nodaļa veltīta pilngadīgu personu darījumspējas ierobežošanas veidiem un iemesliem, kā arī šo ierobežojumu tiesiskajām sekām. Tā kā darījumnespējīgo personu vietā darbojas aizgādņi, trešā nodaļa veltīta, lai apskatītu aizgādnības jēdzienu un tiesiskās sekas, kas rodas, nodibinot aizgādnību pār darījumnespējīgu personu.

The theme for my bachelor’s degree paper is „The restrictions of the capacity to contract of adults and its legal consequences”. Seeing as how the capacity to contract can only be taken away or limited in certain instances of the law, the author of this paper is researching the concept of the capacity to contract, the goals of restricting the capacity to contract and the legal consequences in case the capacity to contract is taken away from an adult. The concept of trusteeship and the causes and consequences of establishing a trusteeship are also researched. The first chapter focuses on the concept of the capacity to contract and its subjects.The second chapter is dedicated to the goals and causes of the restriction of the capacity to contract of adults, and the legal consequences of these restrictions, but the third chapter looks at the concept of trusteeship and the legal consequences of establishing a trusteeship with a person unable to contract.
