Maģistra darba ietvaros veikta galvojuma institūta izpēte. Uzmanība pievērsta galvinieka un galvenā parādnieka savstarpējām attiecībām. Pētīts jautājums par galvinieka regresa prasību, ja galvenajam parādniekam ierosināts maksātnespējas process.
Pirmkārt, īsi aprakstīta galvojuma vēsture. Otrkārt pētīts pašreizējais regulējums un tiesu prakse Latvijas Republikā, kā arī dažādu ārvalstu tiesību akti.
Darba mērķis ir izpētīt no galvojuma līguma radušās sekas, kā arī galvojuma institūtu saistībā ar maksātnespējas procesu.
Darba uzdevums ir vērst uzmanību uz konstatētajiem problēmjautājumiem un sniegt tiem savu risinājumu.
Šis darbs ietver galvojuma institūta un to seku paplašinātu pētījumu, kā, piemēram, ekspromisoriska un neekspromisoriska galvojuma seku nošķiršanu, fiziskās personas maksātnespējas procesa sekas attiecībā pret galvinieka tiesībām celt prasību regresa kārtībā.

The purpose of the Master’s Thesis is to research the consequences of the guarantee agreement, as well as the institute of guarantee in relation to insolvency proceedings.
The main goal of the Master’s thesis is to focus on identified issues and to give a possible solution.
This Master’s Thesis includes a research of the institute of guarantee and an extended research of its consequences, such as separation of consequences between expromissory and non expromissory guarantee. Also the consequences of Individuals insolvency process against the guarantor’s right to bring a subrogation action.
